Hi All,

 

I would like to know if anyone has had a similar experience or issue when they filed their i-751 for ROC and they have had a physical address and a mailing address issue/concern?

 

In my specific case, we decided to keep my wife's parent's house as our primary address for all documents and communications as we have had numerous issues receiving mail when we rented out an apartment. (Just to be clear, we rented the apartment only for our privacy :))  We visit her parents house everyday to pickup mail and we stay there over the weekend as they are only a 5 minute drive away. The only documents we have related to our rented apartment is the rental agreement and internet bill both of which have both our names on it.

 

I'd like to know how to answer the mailing and physical address question under Part 1 of the i-751 and if I have to select "Yes" or "No" for the Q22. As her parents' address was used as the address where we would reside when we did our initial visa filing and as we still access all our communications, mails, tax returns etc on that address, do we still need to fill an AR-11?

It's probably best to file the AR-11 (your change of address) and also the I-865 (your spouse/sponsor's change of address). Your inlaws' address can remain your mailing address, but your physical address has changed. There are sections for both on the form. 

Yes, you're still getting your mail there, and you visit there a lot. But, especially if you're using your lease as part of your proof of ongoing marriage, it makes sense to put it "on the record" as being your address. 
It's not even really that complicated. 2 easy forms, one online, (the AR-11) and one that you have to mail in (the I-865) - so maybe an hour of your time and 46 cents. Better to do that than give USCIS any reason to think you're being less than honest about your living arrangements.

Of all the paperwork, expense and pain in the *** of this process, a change of address is pretty minor. Just do it and get it over with.

That really does make a lot of sense, I just hope that making this change so late is not going to be an issue.

 

We never thought we needed to do this because we were getting all the mail at her parents' place.

 

In the C/O section of the form, can we have both our names for ex: C/o John Doe Or Jane Doe

We forgot to fill out the I-865 (I dunno, I guess I thought it was obvious that if I was moving, so was my husband, so it didn't occur to me until I saw it on here). There was a section where you can write "notes." We wrote in that section (referring to the "effective date" - which we didn't fake, just wrote the actual date we moved) that we didn't realize we had to send in the form for my husband (sponsor) since the two of us moved together.

We just got the receipt that said they've updated hubby's address... no comment attached to it.

So....

maybe you tell them what happened in the "notes" section. Something along the lines of: We didn't think to file this change of address because we still spend significant time at our old address and continue to use it as our mailing address. However, in the interest of clarity, we realized we needed to inform you of both our addresses.

That's not my best writing work, but it gives you the idea. I think that the USCIS probably appreciates our efforts to be as honest as we can.

When you say you got the receipt, are you referring to the receipt of the AR-11 or the i-865? When did you mail that?

 

Also, do you reckon that the effective date for the mailing address in my case would be the same as the date we moved to the new address even though our mailing address never changed?

 

Is it okay to enter Jane Doe Or John Doe i.e. both our names in the Care of field i.e. 6a?

The receipt for the i-865. It's another NOA type form, and it came about 1 week after I sent the form in. There's no receipt that I remember from the AR-11 because you can file it online.

 

There's only one place to write "effective date" so I assume it just means "the day we changed anything". They'll be able to see that your mailing address hasn't changed.

 

You don't need to fill in the Care Of field unless it's someone other than the two of you. For example, for awhile I had some Canadian mail re-routed to my sister who still lives there. Her apartment building won't accept mail that's not directed to an actual resident, so I had to change the address to:

"MYNAME" 

C/O "MY SISTER'S NAME"

So you don't need to fill in that line at all.

I have a stupid question, do we leave the sections not applicable to us blank on the i-865? I was just looking at the form and Part 4 is entirely not applicable to me as I am not using an interpreter or preparer etc. Do we leave fields such as Middle name blank (I do not have a middle name)?

I left Part 4 blank. If you do not have a middle name, you should be able to leave that blank, or write N/A or none in the blank.
