Hello, my husband has filed for i751 Removal of Conditions last April and received an i797 form in June. Now, he is just waiting for his permanent green card to come in the mail. They told him it would be a year extension before he got the card in the mail and his interview passed last August. That said, I am almost 100% sure he married me to live a homosexual lifestyle in the US and as soon as his card comes he is going to leave fast. I need to call a lawyer this week because I don't know ALL the best steps I need to take in order to get him shipped back to his country.. and then of course an annulment or divorced (depends on the state I live in). I have heard once I find out I am being used for marriage fraud I need to move out but I am trying to gain more evidence than just word of mouth before I do that. I don't have much evidence other than being a beautiful and kind woman who isn't desired by her husband and then getting verbally abused for complaining about it...but the whole scam makes sense if he is really gay. It actually gives me peace knowing the truth.

 

After watching the "90 Day Visa" show on FYI channel I can see why MANY gay men will marry a girl in the US so they can safely live that lifestyle here. In Nigeria (where my husband is from and where a LOT of scam artists come from) they will beat you and even possibly kill you for living that lifestyle.

 

I finally found a receipt number for his i797/i751 today...where can I enter it to see how much longer I have before it arrives in our mailbox? I'm not afraid to do what I have to and move on from this relationship but I have to be smart about it. Any suggestions let me know. I have an appointment with USCIS on Thursday where I will ask if they can stop the paper work...or at least never allow him to apply for citizenship. Should I write a letter and get it affidavit before I go over there? Any strong suggestions appreciated. Thanks.

you can't just get him shipped away, a lawyer can't do anything else but tell you to divorce him

 

you can divorce him and move on. he still can remove conditions without you.

 

I'm sorry for what is happening to you but there is always a risk.

 

you can't pull the affidavit of support either, even if you divorce, you committed to be his sponsor until he becomes a USC, dies, abandons his GC or works 40 quarters.

 

so he still can get the 10 year GC without you and he can file for citizenship after 5 years of being a GC holder

 

immigration can receive your letter, but probably won't do anything because couple have arguments all the time

You can file a complaint with USCIS (or more specifically, I think ICE would be the place to go). You can provide your evidence of fraud, but you cannot stop him from filing (or being approved for) ROC or naturalization. He can do those without you as long as he can prove that the marriage was entered into in good faith. Obviously, if you have evidence against that, then it will be difficult for him to prove it was a good faith relationship. That said, word-of-mouth/rumors hold essentially no legal weight. Your suspicion of him being gay is not proof of anything. Even if you could prove he is attracted to men, you would still need to show evidence that he entered the marriage via fraud (i.e. he could (potentially rightfully) claim he is bisexual, or only found out he was homosexual recently). There's a lot more to it than him being attracted to men now (which is still only a rumor according to what you've said) to prove that a marriage was entered into via fraud.

 

It's tough to say where to go from here. If you don't trust him, then divorce may be the best option. I would suggest approaching him about it and getting counseling if necessary. There's a lot of "maybe"s here, and nothing is set in stone.

 

Edit: Just to clarify, I don't think filing a complaint with ICE is the best approach unless there is some real evidence behind it.

It's strange how many couples fight and then the USC thinks they can just "ship" their spouse off like a package after all the sacrifices made. Sickening thought really.
