I have a dual citizenship ( US/Germany) currently residing in Germany, and met my partner who lives in France over the Internet over a year ago. 

Now we are planning on moving and marrying in the US. As I currently don't have a job in the U.S yet, will I have to get one first? Since I'm not sure about the whole sponsor thing - if anyone would be willing to sponsor her. 

And I have a question about the proof of our relationship, how can we make sure they 100% pass with the embassy? 

Could we apply for the K1 visa in the US? Would that be possible?

You have three options regarding sponsorship:
1. You move first, get a job, then sponsor her )you won;t need to file the financial documents until interview time)

2.  You sponsor her on assets, but they usually need to be US based; savings, 401k, second home etc.

3.  You find a US based co-sponsor who will stand guarantoor for her, such as a family member, friend, old co-worker etc.

 

You cannot make 100% sure to pass, but the best evidence is time together; so evidence you live together, or that you travel to see eachother such as plane tickets and passport stamps and hotel receipts, and photos to back that up.  Also, address any red flags such as previous immigration attempts, recent divorce from someone also involved in immigration etc.

 

Yes-ish.  You can apply for a K1 while you live and work in the USA, and she can visit while you apply (and throughout the process, which takes 5-6 months usually).  But she cannot live/ work/ immigrate to the USA until the visa is granted, she can ONLY visit for a max of 90 days on the VWP.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
