Hi All

First of all I just want to thank VJ'ers for helping me from my I-129F (fiance application) up to my AOS application. I never hired an attorney and I just relied to this site. Very helpful website and knowledgeable members.

Yeah! after two years and two months staying here in America, here I am again asking for your help in my I-751. My green card will expire this coming May 29th and my 90 day window will start on March 1st. I started to gather documents needed for application first week of February and planning to submit it first week of March.

This will be my cover letter be like:

Ø  Cashier’s check for $680 payable to U.S. Department of Homeland Security (Application fee and Biometric's fee)

Ø  Completed and signed Form I-751, Petition to Remove the Conditions on Residence

Ø  Copy of Permanent Resident card (front and back)

 

 

FOLDER 2: Evidence of the Relationship

 

Ø  Copy of Certificate of Marriage

Ø  Copy of Lease Agreement showing joint occupancy

Ø  Copies of Financial Records such as:

·        2014, 2015 and 2016 tax transcripts from IRS (Married filing joint)

·        Deposit Account Balance Summary from Chase bank showing joint account

·        Statements from our joint checking account with Chase

Ø  Copy of 401K retirement plan showing my husband (USC) as my primary beneficiary

Ø  Copies of 2015, 2016 and 2017 Annual Benefits Confirmation (from employer) showing my husband (USC) as my dependent

      

Ø  Copy of car insurance with both of our names under it

Ø  Copy of phone bills showing shared mobile/data plan

Ø  Copy of AARP cards (with same number) and copy of AARP envelope addressed to both of us

Ø  Copies of credit card bills and copy of the actual card from CreditOne showing same card number.

Ø  Copies of utility bills under my husband’s name and other bills under my name; showing same address

Ø  Copy of airline reservation for a vacation that we had planned in January of 2016

·        Passport stamps

·        Boarding passes

·        Copy of hotel reservation

·        Pictures

Copies of photos of us together at various events with family and friends throughout the years

 

Copies of any documents we have submitted are exact photocopies of unaltered/original documents, and we understand that we may be required to submit original documents to USCIS officer at a later date.

My questions are:

1.) We used to live with my husbands friend which obviously our names were not included on the lease (that was from Dec 2014  to Aug 2015) and we planned to move Sept 2015. I only have copy of lease agreement from sept 2015 up to now. Do I have to explained it in my cover letter?

2.) I dont have Affidavit sworn by atleast two people/friend. Is that really needed?

3.) We dont have kids yet, so I just leave Part 5 blank instead of putting NONE.

4.) I printed my photos with regular photo paper. Should I write a simple description at the back of every photos or should I paste it on a regular paper and put description on each.

5.) I dont know if I have enough evidences. Please, I really want to know your suggestions/comments.

1.  Cover letters aren't even required; they're chiefly for your reference, as an index of what you sent.

2.  Affidavits are recommended when other evidence is weak or thin.  Yours isn't.

3.  Put "none."

4.  Paste or print on regular paper, with description.

5.  Consider crafting wills, healthcare powers of attorney, and similar documents.  These make outstanding evidence for ROC, and they're even more crucial to have in "life."

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

By saying that my evidence isn't weak, I felt relieved.. Thank you.. I'll follow your suggestions. I hope I will provide your fifth suggestion.

Immigration aside, the importance of having those documents in #5 can't possibly be overestimated.  You never want to be without them in an emergency.  Within a week of my marriage to Mrs. T-B., I had these things prepared, and the feelings of relief were very much worth it.

 

 

Keep in mind:  If you ever move to a different U.S. state, see if these documents have to be updated to adhere to the new state's legal language.
