Hello there,

My fiancé (US citizen) currently makes 120% of the federal income poverty line for a 3 person household. (Our family would be her, myself and her son) We have received our NOA2 (yay) and are expecting a parcel from the embassy in Canada, soon. For the interview (prior to K1 approval) we are in good shape for the I-134 financially, because the requirement calls for only 100% of the poverty line to be met. After entry, upon filing the I-864, we fall just short of the required income level.

 

We both spoken to her mother (who does not physically live at the same address as my fiancé) who gladly agreed to being a joined sponsor on the I-864, (submitting her own copy of the form along with ours, when I apply for a green card with I-485). This will definitely put us far about the 125% requirement. However, prior to issuing the K1, would it be advisable for her mother to fill an I-134 along with my fiancé's I-134 to bring to the interview for the sake of helping our case? Would her mother's I-134 require her mother to appear at my fiancé's interview at the field office in the US?

You US Fiancee does not need an interview at a field office unless specifically called for one.  Even if she does have one, her mother does not need to attend.  However Montreal tends to go by the I-864 poverty guidelines even for the I-134.  So I highly recommend having your soon to be mother in law also be your co-sponsor for the I-134 not just the joint sponsor for the I-864.

Brilliant, thank you for your information. So I take it, under normal circumstances, it's only paperwork that comes from my fiance' throughout this whole thing. She would be notified by whom that a interview would be necessary?
