The thing is I entered without i-94 and never entered the us with one. Last time they brought me here was when i was 13 and only with the b1 visa showing it to the cbp officer.

It's electronic. They might put you in there, which seems normal. https://i94.cbp.dhs.gov/I94/

Enter your name, passport number etc and check.

"Rather than distributing a paper Form I-94, Customs and Border Protection (CBP) will scan a traveler's passport, generating an electronic arrival record with data elements found on the current paper Form I-94.  CBP will make the electronic I-94 available on the website.

You may need to file a FOIA request with CBP to obtain a document showing you entered legally. 

 

It's unlikely you'll be able to adjust without some proof of legal entry; USCIS won't just take your word for it.

Are u canadian? This happens alot!!! Just say when u crossed and by land it shoulsnt be a problem...tbey dont always swipe passpoets and not aways enter data (only half my parents i94 showed up and tbey cross alot)

Not true, lots of canadians enter without getting any electronic i94 or updated online and aos no problem...if you are from the mexico side obviously they wont believe that!

If u r canadian, its fine if u crossed from mexico, that is a whole other ball game:/

Thank you guys for the reply. Well I came to US via car and they would never never swipe my visa. Las time i came was in 2005 and cbp just inspected us and saw my visa and said "have a nice day" thats it. Never had an i-94 and never came to the us with an i-94(B1 visa is expired btw 2012). Perfect example is my grandma she still comes to visit me and they mostly never swipe her visa says. Would it be because we just live in the border and ask where we heading and say just to the border for shopping and visit family?

ok, after seeing you are from texas i now see you are from the southern border.. you probably need an experienced attorney to prove you didnt come here illegally... the fact you had a tourist visa im sure will help.  i would call a lawyer who has experience with this and see or google cases.... i can tell u from the canadian side this happens alot

Yes I'm from Laredo Texas border with Nuevo Laredo which 95% don't cross with an i94. My lawyer said he would write a letter saying that CBP officers would never swipe visas as 2007 and up. He is an ex cbp officer btw. Hopefully i can adjust

I doubt USCIS would accept it as proof of legal entry.

actually, yeah they do and have with canadians/mexicans because prior to 2007.. even sooner you never got stamped to go thru the border they just waved you through.
