Hello VJ members here, My wife's visa was denied on Monday November 30, 2015, and sent back to US, I rebutted with NOIR, and It was revoked in August Last year, we appealed and won. The case was sent back to DOS for visa processing again. I called NVC and I was told that the case is already in Accra waiting for new interview schedule. What should we expect now? I emailed the consulate 3 e-mails but no response

Congratulations on your appeal win.
What were the issues and how did you overcome them ?
I would inquire through a senator when the next interview is after waiting a good 3-4 months after NVC has send it to Accra.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Ebunoluwa I think you know my case even I was seeking your advise and direction when my wife's case was denied and revoked. The issue was bona fide marriage. I have to come up with more evidence and stronger proofs to overcome the revocation. It was tough but with the help of Almighty God

There you go ! ! ! !, you answered your own question.

You need to go with all the evidence you sent to USCIS for your appeal process, have your wife organize and arrange it orderly.

 

Now the most critical part of this interview process is knowledge about the documentation you are submitting for interview. Make sure you go over all the documents, their names and what they mean with your wife. I have seen many people get refused visa for lack of evidence to establish bona fide, but meanwhile the petitioner had provided the beneficiary with all the needed documents for interview. But the beneficiary didn’t know what the CO was asking about. The CO’s in Accra have no time to dig into your piles of documents looking for evidence you brought. So make sure she know what to give them when they ask for anything

 

Example:

The petitioner knew her salary for the previous year was $200 below the poverty guideline, so she filled out the I-864 including her 401K investment account of $15,000, then added all her investment and financial statements and other savings accounts.

Which means she has enough money to not need a joint sponsor, but the CO didn’t see the section of I-864 with investment money and refused the visa, requesting a joint sponsor, however he had all the needed evidence but didn't which one to give the CO

But fortunately she emailed the consulate referencing the 401k documents, she had initially submitted to NVC and the petition was granted.

 

Every case is different but since you initial denial was based on lack of bona fide relationship, I will suggest you provide her all the documents you can lay hands on and educate her about what she needs to give the CO when they ask for  . . .  or    . . . .

 

Also USCIS does not send evidence you submitted with initial application to NVC to be forwarded to Accra, the only evidence that goes to Accra is documents you submitted to NVC, so make sure you bring all documents you sent to USCIS to the embassy.

Kofi Thank you sooo much for your clarification, I really appreciate that. I will send copies of all the documents I submitted to USCIS to my wife in Ghana now, before she is scheduled for interview. Please any idea about how long for the interview to be scheduled?

Accra embassy schedules interview monthly and will be minimum of 30 days in the future, but currently they  backed up, what you can do is email the consulate in Accra: IVAccra@state.gov with all you case details and ask for the status of your case, and when to expect an interview day.

 

Previously the consulate will respond to emails with 48 hours but in recent months it takes up to about a week to respond to your email.

 

You can also sometime get information over the phone, but in recent years they are limiting that, you can always try tho.

Monday - Friday, 8:30 a.m. -p.m 12:00 p.m. and 1:30 p.m. to 5:00

Yes, sorry I remember your name but not the issues. I get so many PM's that I always have to delete because my messenger

is too full and I no longer have old messages as reference.  With all the Ghana returns it is hard to remember exactly everyone's reasons for return.

I e-mailed thrice but no answer yet.

I know in recent months they are very slow in responding to emails, it used to be much more prompt months ago. But I believe they will get back to you once they have some information for you. I will say if you don’t hear from them in about a month, resend that email again.

I will assume you did not send any original documents to USCIS and NVC. Only photocopies should have been sent to both USCIS and NVC.

 

All evidence for the coming interview in support of bona fide can be photocopies you don’t need original copies (phone records, call logs, sworn affidavits, money transfers . . . etc.), the only original document you need during the coming interview are the civil documents (marriage certificate, birth certificate, police report. . . etc.).

And don't worry you can always hit me up with questions if you have any.

Thanks Kofi_Adjoa, Thank God I mailed the documents (Copies Only) to my spouse in Ghana, getting for her coming 2nd interview after her reaffirmation, how long do you think it will take her to get a new date?

Sometimes NVC will hold the reaffirmed petition when there is no available appointment but Ghana makes the interview appointment not NVC. It can still take many months after reaffirmation I have seen anywhere from 4 -12 months.

Ebunoluwa, our case was reaffirmed early last month, the case was received by NVC on Dec. 29, so when roughly do you think I should start contacting the consulate to find out about my wife's 2nd interview date?

I would start emailing twice a months or so starting in February.

Ebunoluwa thanks I will wait then. I even decided to let the beneficiary go to the consulate in Accra to check or find out with the NVC letter, what about that? Will the let the person in? or go and check it ? Just to try, you never know
