Hello,

I am in need of advice, as I was the petitioner for my wife to come to the US under the K1 visa from Germany. She was accepted in 2014 and arrived on the visa in March 2014. We married in May, and filed for her adjustment of status. 
She received her Employement Authorization Card, along with her Advance Parole.
We lived in the USA until July of 2015, when we came back to Germany and have lived here ever since due to family/ personal reasons. This was all before we received her SSN, and Green Card. It was still in processing.

 

Her petition was considered abandoned. We are not planning on re applying to come back any time soon. What I need help with here is on my tax filing. As I still have not filed my 2014/2015 taxes, since I have not been able to find clear information on how do I file as married on my tax returns. She did receive her USCIS number, on her Employment Authorization card, so I was wondering if I can use that when filing my taxes? If someone has any advice on here about this I would be very thankful.

Did you try to call IRS and ask them. They know better. She needs SSN to file jointly or ITIN number if she doesn't have SSN not USCIS number. Also, even if she is not a US resident, you can still treat her as a resident for tax purposes.
