RFIE Poverty Guideline Question

Hello all!

 

I received a RFIE for my husband's AOS today. There were 3 boxes checked. One was checked because I didn't put 2 people on the household size (already fixed that), 1 asking for tax documents (I only had my 2015 tax document available at the time of filing, but now have my 2016), and one that says I did not meet the 125% poverty guideline.

 

I am well above the 125% poverty guideline (the current amount required for two people is 20,025 and I make above 30k), so I was wondering if it had something to do with my 2016 tax return being absent? I had already submitted a letter from my employer as well as 6 months worth of tax stubs, but I am submitting another letter from my employer + both my 2015 and 2016 tax return + all pay stubs since the start of the year.

 

Does anyone have an idea as to why they would have checked that box?

That's what I had thought  I sent in the I-485 to the USCIS before I could file for my 2016 taxes so I didn't even think twice about it unfortunately haha. :/

Did your 2015 tax document that you sent them show you made more than needed for 2 people?

It's possible that they misread it or missed it completely somehow.

Send what you plan on sending it seems like it should be enough.

Yes it does, I made less (26k) in 2015 but I was still well above the required amount. My 2016 return will be with everything this time! 

 

Just sucks because I've heard from other members that a RFIE restarts the process :/

I get the feeling that they automatically x the box about not meeting the poverty guidelines when you fill out the wrong household size, but I could be wrong.

That could be! Kinda makes sense as it makes you resubmit everything.

They almost always check that box if other things are missing or incorrect.
Though the USCIS web site states that an RFIE will reset the processing, it will not and they will continue to process

your case when they receive the items, just a slight delay.

"Slight delay" I'm over two months since my RFIE for the 2015 tax return, lol and no updates on anything. Is that a slight delay?

Yes they do  

 

OP, did you send along w2 with the 2015 return?

Our situation with the RFIE is almost exactly the same. I was wondering the same things. Luckily with good timing we had just filed our taxes and so we sent them my husbands tax return and W2's for 2016, and he definitely made above the poverty level. I actually phoned USCIS about this to double check as in our case the 2015 tax return was under the poverty level but had mailed an employer letter, pay stubs and 3 years of tax returns. The lady said that so long as the most recent tax return is above the poverty level then it wouldn't be necessary to need assets or a sponsor. It logically made sense to me but I was worried so called anyway. 

As for it slowing down the process, I have received confirmation that they have received my response for RFIE and have begun working on my case again, so there wasn't a long delay.

 I got an RFIE for household size they also marked the box regarding meeting poverty guidelines. I think they automatically do that when the household size is in question because then they don't know if your meeting poverty guidelines or not. 

I corrected the household size and resent tax transcripts, pay stubs, and employment letter to show my income is sufficient.

How long after the RFIE did you respond to it? Did they receive it?

I received it on the 12th of December, it was an easy fix. Send it back the next day and updated on the 19th online that my response is received. I will have to call this week for an inquiry.
