K1 Visa Approved - Work now offering to transfer me

Hello,

 

First of all, to those who regularly contribute, THANK YOU!!   This site has been invaluable in working through the K-1 process.    

 

I have been approved, and actually have in hand my K-1 Visa.   I gave 8 weeks notice to my current employer.   They are a large multi-national company, however I was ready to start over in the US.    When I resigned however, they surprised me and have asked me to consider an inter-company transfer and want me to start working right away.

 

I have no desire to jeopardize my future so my immediate reaction was sure, but you'll have to wait until I get my EAD (which could be 6 months or so).   They want to know if it's possible to apply for a work visa on my behalf so that I could start work immediately.

 

My assumption is, that you cannot have 2 visas at once... and therefore the answer is no, they just have to wait if they really want me to continue working.   I am asking however, if anyone knows for sure that it's not possible, or how I would go about being certain?

you could have gotten an L1 transfer visa quite easily and then AOS from that.  

 

Or, you could just get married now, apply for the CR1 and work with your company until you get your Greencard which you would get upon entry and then from there you could work immediately (that would be the smartest thing so u could keep working in canada and then work for the USA firm upon entry into USA!) Of course, that takes about 10-12months, but if you started that when you started the K1 process, u would wait almost the same amount of time but be able to keep working and you are generally able to visit while your CR1 is waiting (especially as a canadian with strong ties back home).

if you have your K1 visa now, then that is your quickest way to keep working.. i would enter asap, get married ASAP and apply for your greencard ASAP and your EAD will be 3 months! (you MAY be able to expedite it but thats like a few weeks if that!)

so, i would just enter as close to your wedding date as possible and tell them it will take 3 months and see what they say.

It's possible to get an EAD before getting married when you arrive on a K-1, however, it's only valid for as long as your i-94 is valid (90 days) and it takes around 90 days just to get it and will cost you a few hundred bucks. But, since you already have a job offer you might be able to get it expedited.

If a large multi-national HR will know to engage a immigration lawyer, remote working and on a original country domiciled contractor type contract with internal cross-charging has been done millions of times. It is not illegal .... there are ways especially if you have to "drop" back to HQ as the timeline is short for the visa sorting out.

 

If concerned, delay wages payment so you get a move bonus after your hapy with your EAD etc. As I said there are many ways a good international HR manager can help you out. Just need to speak to them.

EAD's can be expedited with a job offer. You can continue to work, being paid in CAD$ to a Canadian bank account until the EAD can be processed then transfer to the US branch.

Actually the same thing happened to me when I resigned, they offered me a job in New York and I thought I would have to wait for AED to start working, I will try to hurry the process with a letter from my employer...

Search the forum and you will see people do it all the time on a K1. Its a gray area of course, but I've yet to see someone with an issue since I joined the board in 2012.

put it down on your application - do not lie!!! i worked 'unauthorized' under my US social 2yrs without authorization and it wasnt brought up! never EVER EVER claim to be a USC!

unauthorized work is forgiven just like overstay is forgiven! so yes work, get paid in canada and when it says 'job' put down your job and what it is and where and until present or whatever! its a non issue when you are marrying a USC :)

i know you are not using a US social, but yes, you are in the same 'grey' area and no matter what, they can not deny u bc of that! just put down on your application the job and your start/end date!
