My Wife and I received a letter from the USCIS that we were unable to complete the application for Permanent Resident.

And requested some documents to be submitted.
 
This is what's in the letter:
 
*Submit all supporting tax documentation 
(W-2s, 1099s, Form 2555 and all supporting tac schedules) submitted to the Internal Revenue Service fornthe most recent tax year.
-The petitioner/sponsor must submit all supporting tax documents for the most recent year
 
It says here that submit all supporting tax documents for the most recent year?
 
My concerns and questions are:
 
Just wondering because my wife didn't have the past 3 years W-2's so she requested a transcripts of records from IRS December 2016 last year and got the 2013,2014,2015 tax years. We were able to submit our application January 2017 first week.
 
So my question is:
 
Was the documents she passed from IRS not enough? Or not the right one?
 
Or 
 
Or is it because we got the tax return this year, so they need the money 2015?
(another question is: My wife didn't file the tax return yet, so do we need to wait for her to get the tax return? Or the W-2's she have right now from 2016 is ok to be submitted?)
 
pls I really really need your help.

She can request the w2's from the employer. I've seen ppl getting requested for w2's even when sending transcripts lately. You don't need the new tax return yet, sending the current w2 can help prove the current income. What other evidence of current income did you send? It's almost a year since the last return was filed so it might be that they simply didn't have enough proof of current income. You could also choose to file your taxes and send the 2016 1040 with the w2. Pay stubs and employe letter are other good evidence.

If they specifically asked for supporting documents after you sent the tax transcripts, she may want to see if she can get copies of her previous W2's, 1099's etc... from her employer.

Did you submit the tax return transcripts?

 

The USCIS is requesting the 2015 entire tax return including all schedules, 1040, and W2s.  Everything she would have submitted if it has been a paper return.  She can request those from her HR department if she did not keep a copy of her W2.  They are not asking for 2016 tax return as that is not due until April.  Do not send the 2016 W2 by itself.  That is an incomplete tax return.   

 

As a note though, everyone should keep a copy of the last 7-10 years of tax information if you are by chance audited by the IRS.

It is the form I-864 affidavit of support. She did ask everything when she called IRS because she did not have her past W-2s and when she got everything from IRS she submitted it all. I just don't understand why they still ask the recent, when we submitted everything? 

Because this is what is in the letter:

No she cannot just send the 2016 W2.   - if she did this is an incomplete tax return and they will RFE for the rest of it!

If she get the W2 from 2015 and file the tax return, then we still need to call IRS to ask for transcripts from the most recent 3 years right? 2014,2015,2016?

I thought you submitted thetax return transcripts?  No if she gets her w2 she needs to submit the entire return that she submitted for her 2015 raxes.

OKay have you submitted the AOS yet and this was an RFE from the USCIS or have you not submitted the AOS?  

 

I thought you had gotten an RFE but it sounds like you haven't submitted anything yet, in which case, submit the tax return transcripts from 2013, 2014, and 2015.  That's all you need tax wise.   Then submit 3-6 months of current pay stubs and/or a letter from her employer stating how much she makes yearly.

I already submitted the AOS and after that the USCIS mailed us an RFE. When we submitted the AOS and the I-864 form before, my wife submitted the return transcripts too from 2013,2014,2015. That was mailed from the IRS. So when we got the RFE, I was surprised because we submitted the latest return transcript from 2013 to 2015. That's why I think they wanted the latest tac which is the 2016.

 

and another thing is her income did not meet 125% of the poverty guidelines for the petitioner household size. So my uncle who is a citizen will be the one to joint sponsor me. 

So my only problem is right now, is about the tax documentation.
