***I-751 Journey***

01-02-2009 Mailed in I-751 application

01-12-2009 Temporary resident status extended for one year

Sorry I pressed "enter" by accident...

I received my green card a couple of days ago, but I have had no update on the EAD or the AP since the NOA1/biometrics. I know it doesn't matter now that I have the green card, but it's almost as if it doesn't even matter that I applied for them and spent hundreds of dollars on the applications. Are they already lumping all the applications in together? What a waste of money and time!

Also, I went to the SSA office yesterday to update my card status and the guy told me that I was actually ALLOWED to work during the 90days that I'm in the US on the K1 Visa! He said that I didn't need the work authorization stamp for those 90 days because those are the rights of people on the K1 -- is this true or am I once again being told things that aren't the facts?

It is quite annoying, I applied for my EAD, when I received it, it had taken 3 months to get to me and it was already out of date! :huh:, then about a month later I received my green card, so in the end it doesn't matter you can work once you get your green card, go on holiday, wherever, but yeah, we just waste our money, applying for AP and EAD, when in the end your just ganna get your green card anyway which will just let you do those things, I guess USCIS is just covering their backs, just incase it takes ages for your green card to come through, then if you do get your EAD and AP before you green card you can work and what not, nothing is ever simple. :wacko:

2/5/07 - 2 Year Green Card arrives!!! YAY!!!!

5/10/08 - Received RI Driver's License!

11/10/08 - Removing Conditions - Sent package out!

11/19/08 - Received Notice of Action - 1 year extension on my current green card - now waiting for biometrics letter.

11/28/08 - Received biometrics letter.

12/12/08 - Biometrics appointment - 10am.

01/13/09 - Still waiting............

06/08/09 - Card in production and on it's way!

06/22/09 - Received 10 Year Green Card! YAY!!

Beware of asking SSA people about USCIS issues, and vice versa. You don't ask your auto mechanic about your leaking toilet, do you? Maybe he'll have the right answer, but asking a plumber would be better.

In this case the SSA person is correct - a K1 is allowed to work during their 1st 90 days in country whether or not they have the EA stamp. The person must be able to show the employer an approved EA document, but they have 90 days to do that. The thing is, many (most?) employers may understand the requirement to be that they must see the EA stamp or EA card right away. It's a debatable point - been debated frequently here on VJ anyway. So as a practical matter, although a K1 may be authorized to work for 90 days they may have a hard time finding an employer who agrees that they can hire the K1 unless the K1 has the stamp or card in their possession.
