HELP!

 

So, after 7 long years, it is time for my to go back to the states along with my fiance, with whom i've been with for 5 years.

 

Looking at this form brought up so many questions, and searching for information hasn't really brought up enough answers. 

 

so, regarding the i-129f:

1. we are planning to live in Chicago, a city neither of us have been to, but i do have a job opportunity there. i plan on staying with a friend or her sister for a week or 2 while searching for an apartment. should i just put her apartment? or would it be better to use my parents address (because it is stable?) in texas, even though i have zero plans on staying there?

 

2. mailing: i can't file from here in south korea, but i can send home to texas and my parents can forward it to Dallas, right?

 

3. evidence: I've been working here in korea as a teacher and my partner's apartment is about 15 minutes from my home.  We literally see each other everyday. My alien registration card has my name, photo and address on it. I feel like this is the most solid documented evidence that we've met in the past 2 years, but should I include a map as well? We will go on and submit letters, photos, texts etc to each other as well! 

 

4. FINALLY the biggest concern: Evidence to support my spouse! This has brought up so much anxiety. He just graduated college, and while his family is going to be helping him out a bit, he doesn't have anything directly in his name. As for my, i have my pension which has been collecting money for the last 7 years. It is a nice egg, and while it is mine, it does not appear in a bank account. I can request an official form with the amount which is saved up in there, as well as my job  HERE in South Korea.

Evidence to support your spouse is based on the poverty guidelines  at 125%. For a family of two you are required to make $25,025. Im guessing if you have a pension you have been working, did you file your taxes in the US? Even if you were to include your pension it will not be taken at 100% value. They use a formula to determine your assets' values and that amount has to exceed the guideline by a certain amount ( I believe 3x). You may require a sponsor if you did not file US taxes in the last 3 years to be able to show what you earned in 2016. There is more to it though. You have to reestablish your US domicile etc. Thats not hard though if you kept at least a bank account in your name here. They consider it as evidence of your intent to return. Your Pension may suffice for that purpose.

You can use you parents address as a mailing address but you must put your physical address on the document as well. You can mail your application from Korea as long as it goes to the correct address for the state in which you plan to live. Im not sure what your timeline is for moving back but the process is roughly 6 months to 1 year...

Could I possibly submit evidence of my salary here in Korea? Is there an amount the co-sponsers need to show they earned if we do go that route? 

As for reestablishing my domicile, this is new information! A quick reading up on that entails closing my Korean accounts and some ort of letter of resignation from my employer, as well as proof of contacting landlords, all which are things I will be doing.

Probably not for Korean Income because it will not be ongoing once you leave. It includes also Proving your ties to the US with like an ongoing lease or bank account or bill which establishes you had every intent to return, other wise there is a form for that.  https://www.uscis.gov/forms/direct-filing-addresses-form-i-129f-petition-alien-fiancee

Poverty guidelines for a I129F are just 100% which is 16,020 per year. You submit the I-134 affidavit of support not I864. For your income I would suggest you go home and get a job in the US, then when it comes to the interview you will have proof of income to send your fiancé for his interview. My wife done the same thing and the embassy accepted just 2 months worth of payslips from her new job. You can also get a Co-sponsor for most embassies.
