Well, USCIS 'says' you can't. That's why they won't issue a visa for the fiancé if the fiancée is still married.

Yes, that's more on the fact that they cannot fulfill AOS because they can't marry.  Not the fact that you cannot have a fiancé while married.

Legally probably so, logically how can you be engaged to be married and married at the same time?

 

Used to have a legal status in the UK but that was back in Victorian times, you could be sued for breach of promise.

 

A BF/GF etc has no legal standing.

Being engaged isn't a status that way.  Logically divorces take time and people move on.  My marriage was long over but the divorce held up by a bitter husband.  We got engaged anyways because we weren't going to let his anger get in the way of our happiness.

Of course I used that site, amused me.

 

Immediate Relative has a meaning as far as US immigration is concerned. And by definition a Fiance is a prospective relative, not a current relative and certainly not an immediate relative.

then why is it on the DS160 form?

 

Again, I'm pretty sure I saw that drop down box. But I can't verify since I'm not about to file a DS160 form and can't find it anywhere but on the infamous site (I'm only pointing it out b/c it amused me too).

It is a long time since I filled one in, and only being on that site is a bit of a clue.

 

Think about it logically, you can be a Fiance one minute, not the next and again a minute later, means nothing.

Bottom line is nothing is stopping him (not you) from applying. He has to start with a school he wants to go to and be accepted. Depending on the school he will need to show in his bank account he can afford it. Some schools want to see at least 2 semesters that can be in the 10's of thousands. Just FYI.

 

As far as you buying a house in Nigeria has nothing to do with him and if and when he returns. Nigeria has a bad record of people not returning or suddenly finding love and dropping out of school.

Agree. My former colleague from PH did applied for Student visa (was granted anyways) but he mentioned to me how his interview went. I did considered at some point taking my masters here in U.S.

The CO specifically ask how he was able to afford his education. What's his source of income. What's the math how he had this amount provided he is earning this and the CO went to check bank statements to prove that his money just didnt pop up from nowhere.

DS160 does indeed have "fiance" in the drop down for immediate relatives. I filled out 3 myself, and I recently helped my parents apply for their visas and remember it well.
