Learning not to call USCIS and trust their predictions.  Lady on the phone told me today it would be 60-90 days from today, March 1st. Do you agree @geowrian ?  Trying to get ready to purchase another plane ticket to Africa.  Number 4, as I've been Nov, Dec, Jan, and now March.

it' hard to predict that far in the future, but there are about 4000 unworked cases ahead of yours. At the current rate, you're looking at about 27-32 working days before your petition is processed if they worked in a strictly first-come, first-served manner. Given that they don't do this and with the current data, there is approximately 85% chance they will process your application between March 24th and April 14th (assuming I can count working days properly).

Whoops...I was one week off. ehehe...

Hi everyone, maybe someone can answer this. My fiance and I will be coming to the U.S together once approved. Are we able to stop in a different country and vacation there, then fly over to the U.S? I am not sure how strict the guidlines for a k1 visa are. I do however know that once he enters, he is not allowed to exit and come back in until he gets his green card.

Thanks in advance.

Hi! I had the same question and e-mailed the U.S. Customs and Border Protection (CBP) INFO Center. This was their answer:

"Travel to a different country does not affect the K1 visa.  You can enter the US from any country with the K1 visa.  When you enter the US you have to get married within 90 days and then apply to change status.  You need to get Advance Parole or a US permanent resident card before you leave the US."

Hope this was helpful :-)

Tax transcripts are the official IRS record of what was received and was processed. Tax returns are what you submit to the IRS. There's no way for a third party (i.e. USCIS or COs) to verify that a tax return you give them was actually submitted to or accepted by the IRS. It could just be a filled-out form that you never actually sent. A tax transcript has an extra aura of validity since it's a record from a government agency. W2s are what you get at the end of the year from an employer that states what you made, what taxes were withheld from your pay, etc.

For the I-134, the minimum documentation is noted here:

https://www.uscis.gov/sites/default/files/files/form/i-134instr.pdf (Page 3)

http://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter5-17.html

As for which one to submit, the tax transcripts are preferred. There's no harm in including the W2s with them as well. Sending the last 3 years is ideal, but only the past year's transcript (2015) is technically required. You may use the 2016 transcript if it was submitted already, albeit I think there's a several week lag time from initial filing to first availability, so 2016 transcripts may not be available yet for most people. If you can't get the transcripts in time, then you can use the returns but be sure to include the W2s and any other relevant documents supporting it (i.e. you don't want them to question if it is accurate or not). COs aren't tax professionals so don't expect them to comb through returns or transcripts, but they know how to look at the basics to determine your financial capability.

Tysm for the detailed info.  I passed it to my fiance.  We are worried cause in the past years his tax info will show a low income. Since September last year he started a new job and the new income is more than enough to cover the poverty line. We were advised in the forums to get a employment letter stating the current income and that he was a perm contract etc.  We are still nervous they might require a sponsor (which we don't have) and get denied. :(

Thanks geowrian.  If I'm reading the report right, there are around 12 applications touched each day for my filing date (11/28/16) at a minimum.  With around 110 untouched, hopefully an approval in the next 10 working days :)

Same date. WIth 2/3 of our cases being already touched I can't help but think I won't get mine dealt with anytime soon/get an RFE/get a rejection because life hates me.

Fast approaching 90 days and no NOA2. Here's to hoping notification soon.

I know all that's required is 1 face to face in the prior 2 years. Will this extended delay in processing adversely affect the K1 without seeing each other?  Our plan is I return to Thailand and fly home with her when the visa is approved. Should we try and schedule another vacation together albeit a short one while being processed? It would only be a week vacation so I still have vacay time on the books when the visa is ready.

To my understanding, the requirement is that both party have met face-to-face (in real life) 2 years prior to the time of FILING. The back end to the Requirement is continuous communication between the two. I do not think having to stay away for more than 2 years (given that you have met each other two years prior to the time of FILING the application and have been keeping up with the communication proofs between you two) would affect the K-1 processing outcome.

You sound like you'll be at the interview at the consulate with your beneficiary. That's what I am planning to do as well as having more pictures ready for the interview. You'll be fine I think but if you have time to spare, it doesn't hurt to see your loved one.

Hi all,

Just curious what the status is for the November 2016 filers that have NOA2 on the transfer time to NVC?

Our NOA2 date was Feb. 2 and still hasn't reached NVC.  I know they say allow up to 6 weeks, but well..it's been 4 weeks now and getting a bit anxious.

That's a bit odd, I wonder if USCIS even sent it to NVC. I have same date for NOA2. Look at my timeline. NVC should have issued ur case number by now.
