Hi guys! My case is now Ready at the Embassy for the interview but I'm having problems to schedule my interview. When I try to set an appointment this is the message I get: "No valid record can be found for the entered receipt number. Please validate that your receipt number is correct "

 

Anyone else with this problem??

Really? I got approved on 17 feb but still not call to nvc cause i think still soon! 

You should go to ceac.stage.gov and use that case number to checkif you case is ready that mean it moved to your embassy already.

 

I was NOA2 approved on February 16th - I called NVC this morning and they had not received the packet from USCIS yet. I will call again tomorrow.

I only saw 1 person who was not really denied she got a 221g form because her mother's name did not match on her birth certificate. But almost all of us got approved that morning :)

What other good is the NVC case number? Exactly how will having the case number speed up the process?

I'm not sure how the US Embassy works in Singapore but getting our NVC case number shaved off about a couple of weeks from the process. Basically in Manila, once you have your NVC case number you can pay the visa fees and schedule your interview even if the case is still "In transit" to the USEM. You just have to make sure that the USEM has your case at the day of your interview. I hear that in some countries, the ceac status needs to be "Ready" before you can even schedule an interview, which takes about a week or 2 from the time NVC receives your case.

Not sure if it's the same in Singapore, but in the Philippines I've read that you need to have a scheduled interview or at least an NVC case number before you can go in for medical as its one of the requirements that you will bring with you. My fiancée will have her medical next week so I'll know for sure what the process is.

Hi all. Im really in a jam and worried :( sorry for a long question here but any help is much appreciated. 

I am the beneficary and my USC fiance is facing trouble at work. He might have to search for another job as his current project isnt too great (and some office politics) and he might get 2-3 months of severance pay as well. Henis then willing to search outside for a job and should manage to find smthing good in 2-3 mnths. 

He has enough bank balance and with this extra payoff , he'll have enough savings to show that he can support me for 6 months easily or even more. 

Is the scenario ok  for k1 visa? Whats the beat option here? Does K1 allow to show bank account as an asset? Or should he stick around the current job itself till im there. Confused :(

I'm sorry to hear about his situation.

 

Yes, you can use assets instead of income. He will need 3x the federal poverty level (100%) for the I-134, and 125% of it for the I-864 (during AOS). In some circumstances, they may only use the difference between the necessary income and what he makes, then 3x that for assets. Assets can only be included if they can be converted to cash within 1 year without harm to the sponsor (i.e. he can't count his primary residence - even w/o a mortgage - since he still needs a place to live). He will need to provide the last 3 years of tax transcripts (not just returns) as well.

 

It would not be a bad idea to have a joint sponsor lined up in case they do request it. Even if he does meet the minimums, they look at the totality of his circumstances to determine the risk of not being able to recover funds if you became a public charge, and could request a joint sponsor. Hopefully it's not needed, but having one lined up just in case would be beneficial.

Thanks geo... this is wat confused me actually. I read on some forums that bank balance cannot be shown or any assets for that matter for K1 visa. These can be shown for i130 though. Thats why im not sure. I read that embassy wants the petitioner to have a steady income and bank balance isnt a steady income and if there's no job then its actually depreciating. 

Its me who knows he'll find a job - but embassy would fear that there's no guarantees. 

There cnt be a cosponsor. 

Dunno whats the best way. 

How would someone between jobs file for 129f if they dnt have a cosponsor?

There's some debate that certain embassies don't like to go by assets for a K-1. I really can't speak to that aspect other than it's just something people are saying. The law permits it and I-134 supports it...how that is implemented can be a different story as the CO does have a lot of discretion in the matter when making the determination of risk.

Correct. How long did he have his job? If it was for a long period of time and it's just being terminated, I would hope the situation would be understood as just bad timing. Hope isn't policy, but since so much is up to their discretion, I do think it would be favorable to have a good, steady work history.

 

No joint sponsor for the I-134 in India? Darn. That varies from embassy to embassy, unfortunately.

Well, the optimal solution would be to try to hold on to the current job at least until the visa is issued. For AOS, a joint sponsor and/or assets are definitely available. If that's not possible, then I would suggest proceeding with the process normally while he tries to find another job (and provide assets with the I-134 in case it will be accepted). If the CO still doesn't like that but is otherwise fine with issuing the K-1, then it will be put into AP pending a new I-134. As long as it doesn't expire (and you can request that they keep it active), it will just sit in AP until he can prove that he meets the financial support requirements. Once they get a new I-134, they can review it and then issue the visa (assuming it's good). It'll delay the process, but it's better than a denial and having to refile.

 

Edit: Note that the medical expires, so a new one might be requested if that time period has passed by the time a new I-134 is submitted.
