Hi Everyone, 

 

My fiance was placed in Administrative Processing at the visa interview. Then 3 1/2 months later, the visa was denied. We sent all we could when we filed the I-129F. The Pakistan embassy is known to be a tough embassy.

 

He brought new evidence with him at the interview but no additional documents were requested. 

 

At this time, we are planning to re-file a K-1. However, we have had a challenge finding the reason for denial. We have attempted senatorial and congressional inquiries but no concrete information has been disclosed. The embassy refers me back to USCIS and USCIS refers me back to the embassy.

 

Any advice on how to obtain the reason for denial and any info on what we can do differently on re-filing the K-1 would be truly appreciated.

I'm sorry to hear about the refusal. Yeah, that embassy is notoriously tough. Good luck in the future!

 

For a K-1, the petition will be sent back to USCIS where it will sit to expire. They don't review the returned I-129F anymore. To cut a long story short, this is typically a net gain because it removes the chance of finding of fraud (which would then need to be overcome when you re-file, which is not easy). The drawback being you need to refile.

 

As for finding out why, if the senator's inquiries aren't getting anywhere, then you may need to file a FOIA request to determine the cause. This is not a quick or simple process, but it's generally the path to go. As for the specifics on how to do so, I suggest searching for other threads here (or seeking professional assistance). If the request is improperly filed, too broad, or directed at the wrong people, they'll come back with nothing and you have to start over.

Hi everyone! I hope somebody's still on here! :D

 

I'm an August 2017 filer (I know, still very far from my approval...), and well, I did a lot of research, let's say, about the processing times for the K1 and all that. What I've noticed is that in October last year it took around 42 days on average for approval, while in November it took more than twice as long on average (94 I believe, according to VJ). Since that's quite a bit of a difference, I was wondering if anyone on here knows what caused the delay? I'm just super curious, especially since approvals lately seem to take longer and longer. Thank you in advance! :)

I was K1 November filer 2016. And yes, sounds like the process runs very slowly after October. I think the biggest reason was the gorverment changed the fee, more $200 at the end of the year, so lots of people tried to send the packet before it. And the second, people are afraid of Trump will have some ideas about immigrant and it will effect them, so they filed the file before he became a president. And I guess the third, K1 seems pretty easy, the processing time is still shorter than spouse visa, and people want to reunite with there beloves one quickly. I think thats why lots of people choose K1. 

 

Just my opinion :D

Yeah I believe it took almost 90 days for me as well, but not quite. We got NoA1 on November 10 I believe? Then NoA2 at the end of January, so almost!

 

Reasons that I think delayed it:

 

1) Some internal stuff, because I guess the Obama admin wanted to make sure a lot of things got done before Trump admin makes big changes on immigration (this is the conspiracy reason lol)

 

2) Just the amount of holidays that were between November and January.

 

3) The overwhelming amount of filers because they were trying to avoid the increase in fees.

Thank you guys! I was hoping for a mindblowing discovery about the delay lol, but I guess this does make sense. :)

There doesn't seem to be a big increase in filers in November though, that's why I was so confused. But then again, we can't be sure of the actual number of filers as not everyone's on here... Oh well! :) I just hope they hurry up! :wub:

we filed for AOS and Work Authorization at the end of Sept 2017. We got the work auth but still waiting on the green card interview. Marriage has been quite challenging, but growing thru the challenges. Finding work seems next to impossible since people in the US are not trusting of a degree in Accounting earned outside the US even though I have 2 years work experience.

10/16/2015-------Started Dating ( we had met in person in 2012 and been friends thru the years)

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
