Hi! I'm the beneficiary and I have a doubt. On my G325A form (filed on October of 2016) I marked "unemployed", because at the moment I wasn't working, but it was because of a license (or how they called it in Venezuela: an unpaid work permit). That means that I'm still an employee but as long as the license was valid I wouldn't go to the office (of course) and wouldn't get paid (obviously). So since I wasn't going to the office nor getting paid, I marked "unemployed" because for me, it seemed like pretty much the same. I asked for it (the license) to my employer so I could finish my thesis and do my internships (I have now a bachelor's degree in human resources). The license was valid from April to October 2016. On November I returned to my job. Then on December I quit.

 

My interview is on Friday and I'm worried because when I filed the DS-160 I said that I have worked in that company since January 2014 until December 2016, which is true. But since I marked "unemployed" on the G325A, I'm scared they might think I was lying in some point. I have an employment letter that says I worked there since January 2014 until December 2016, also I have a letter from the company where I did my internships (From May to August 2016). And just in case they ask for it, I will be bringing with me to the interview my venezuelan's tax returns from the past 3 years.

 

Do you guys think that would be a problem at the interview??? :(

Yes, we got the same one.  We were approved on 03-29-17.  I called NVC just now, the lady said they have not received my case and it will take like 6 weeks.  She also said that even though the letter does mention that it will be forwarded to the listed consulate, it does still have to go through them.  So, I don't know what to think.

We will call on Friday and will update you guys what was the response from NVC

@geowrian sorry man I made mistake so she started working for a Dr as a massage therapist her taxes for last year does not make over the poverty line but her new job she has she is full time employed and her annual salary for year works to $64800 so our can she still be the only sponsor if her taxes were not over the guide line but her salary for this job is high? We are stressed out about this as we don't want to get placed into AP OR DENIED

Same here! My interview is in TWO DAYS!. My fiance's taxes for last year didn't make it over the poverty line because he was living here in Venezuela and moved to the US a few months ago. Our lawyer told us we didn't need a joint sponsor since his new job DOES make over the poverty line. So, I think that's not a problem. I will be bringing with me to the interview his employment letter, paystubs, and tax returns from Venezuela and US (forms W2 and 1040), just in case they ask for it.

That's up to the CO to use his/her discretion (it always is technically). Some COs may look at a new job with more scrutiny than others, and prefer to look at the history. Honestly, I think you would be fine...South Africa isn't an "easy" embassy by any means, but it's far from the most strict. The I-134 isn't legally binding and you have to go through AOS anyway, so COs tend to be fairly lenient here compared to AOS. I guess what it really comes down to is if you think you're safe as-is then go for it...worst (realistic) case you get a 221g pending a joint sponsor. They won't deny you outright for being borderline on the financials. Or you can get a joint sponsor as a backup. I don't think it's needed, but if it relieves your stress to have one, that's an option.

 

Don't let it get to you or overly stress out about it. Take a deep breath, step back, and look at the totality of the evidence. :)

I have the same timeline as you and also for the Philippines. I plan to begin calling on Friday also but I hope that we get everything done soon. Not too much longer now, for sure.
