Hello. I have a couple of questions for those who have a Filipino Naturalized USC petitioner with Filipino beneficiaries as well:

1. After NOA2, Do we need to secure a copy of the Philippine birth certificate of the USC petitioner? Or is his naturalization certificate enough?

2. USC petitioner was a minor (16yo) when he was petitioned by his parents to the US. But he acquired his Naturalization at the age of 20 (no longer minor). My question is, Do we still need to secure a Philippine CENOMAR for the USC petitioner?

Hope somebody can shed some light on this. God bless :)

Aloha

  1. Neither is needed anymore. The proof of citizenship is only for the I-129F, which was already approved. The CO will be looking for the beneficiary's birth certificate, but he shouldn't ask for the petitioner's BC or naturalization certificate.
  2. No. USCIS already processed the I-129F, meaning he is free to marry under US law.The CO will only need to verify that the beneficiary is free to marry under PH law (via the CENOMAR).

Edit: Actually, even that's a bit misleading. The CO will technically look that the beneficiary is free to marry under US law as well (following PH customs). It's technically possible for a Filipino national to get divorced outside PH. The divorce is not recognized by PH so they would get a CEMAR, but the divorce is still recognized by the Manila embassy.

Thank you, @geowrian. Okay, no need for my fiance (USC) to get a cenomar/cemar as he was never engaged in any marriage here in PH eversince he became a naturalized USC, and he was a minor at his POE to the US under parent-petitioned child visa.

BTW, our warmest cheers to your NOA2!! ??We're so happy for you and your sweetheart here in PH. May we also get our NOA2 by early or mid-April. Our received date is Dec 28.

God bless ? And Aloha!

questions to those who would have their interviews soon; will you present the same proof of relationship you included in your i129f packet? I am not sure whether to include only proofs of ongoing relationship after i129f submission leading up to the interview date or to include previous evidences. I visited my fiance after NOA2 and thought, our recent pictures and convo/call logs should be enough. Appreciate any advice on this. Thanks!

My interview was last Wednesday, March 22. I had with me proofs of ongoing relationship: screenshots of our convos on viber, emails, boarding passes from our visits that we made after we had filed I-129F, some recent photos. None of that was needed. Actually, the only thing that I needed for the interview was affidavit of support I-134 and proofs of fiance's income.

Hey guys  I would like to know if moving to a different state would affect our visa approval we have a co sponser in California and my fiance is planning to live with her cousin in Georgia would that still be OK to the CO or not

it is ok for the U.S. citizen petitioner to fill in the answers for the fiancé beneficiary, but the fiancé beneficiary must be the one who electronically signs and submits online Form DS-160.
