Filing taxes for aos penalty for health coverage

Hello everyone 

 

We are preparing our taxes and our accountant informed us that we may have to pay penalty for lack of coverage for my spouse. My spouse was undocumented prior to July 2016  when he got his SSN and started working.His company started his coverage in November. I know you can go up to 3 months without coverage in between jobs so I was thinking if there were a penalty it would have been for October only. Please shed some light if anyone has info. We are filing married filing jointly. I

when did he enter the us. the irs has a presence criteria so if he was in the us documented or not he still would have been required to have health insurance. a ssn is not required to get health insurance nor is legal status when you are buying it directly from the insurance company.

If it's 3 months or more the short gap coverage exemption can't be used at all for any of the months. What you described would be part of July, August, September and October. If you are covered for just one day in a month it counts as being covered the whole month. However, even if it somehow were to count as him being covered in July, this would still be 3 months or more since there were no days covered in August through October.
