Hello All, 

I have few questions about tourist visa. 

My dad had his interview today at US Embassy in Philippines,unfortunately he failed. He was so nervous caused him to give a wrong answer. The question was what is your job... On DS 160 we put retired because he is not working anymore but his previous job he was a carpenter. So he said he is a carpenter. My dad didn't elaborate that it was his previous job. Anyway, My questions are :

When he can reapply for US tourist visa ?How long does he need to reapply?

How can He get an interpreter? Is that something he needs to ask prior to his interview at the embassy?

Do we need to change any information for Ds160? Or keep how he answered it online? 

 

I really want my dad to come here on May because I will be graduating that month.

There is no time limit he can apply as often as he likes.

First, sorry to hear that.

 

Second, he didn't fail. He made a mistake. If he intentionally gave the wrong answer, then that would have been a much more serious issue (misrepresentation).

 

He can reapply anytime. That said, unless there is a significant change in his circumstances, he is likely to get the same result. I don't think just listing a different/no occupation will just be convincing ties to his home country to prove anything different to the CO. I could be wrong, but that's my take.

 

I will defer to others for the interpreter..I don't really know anything on that aspect.

 

Just fill out the DS-160 with fully and honest answers as of the time it is filled out. Don't go trying to match answers to anything that was incorrectly stated in the past. Just be honest on the form.

If he is retired, then note that he is retired. Consciously filling up the forms with incorrect info is misrepresentation. I would recommend he would bring more paperworks proving ties to PH. Proof that he will be returning back to PH. 

 

I really want my dad to come here on May because I will be graduating that month. Maybe you could send him a certification from your course/school department head/teacher attesting you are graduating. Or an invite letter from your school addressed to your dad inviting him for your graduation. 

I personally had applied a B1 visa (2014) and B1/B2 visa (2015). Both were granted and approved. IDK if it is advisable but it worked out for me. I always bring with me an official invite letter from a company/establishment as a proof of invite especially if there's a special event to attend.

When the CO asked, what's the purpose of your trip to the United States? I responded with "to attend a seminar at XXX" then hand the invite letter. Note: it has more weight if it's from a school/company rather than an individual who says "im inviting my dad and i will be paying for his trip". Some COs do look at his financial capability as a factor in assessing the visa application.

Agreed. I don't think the job issue was the nail in the coffin. He likely couldn't prove ties to return home.

 

Invite letters generally have little sway. COs (and CBP) don't care why you're coming to the US. They care why you have a compelling reason to leave the US. An invite letter, especially from a relative or significant other, shows ties to stay in the US, not leave it.

Agree. If it's from third party hosting an event, it could work. But, from a direct relative/significant other/anyone whom you can adjust status from him, it can have the reverse effect.

My dad had tourist visa interview yesterday. Unfortunately he was not able to answer correctly. His English is not very good. The US embassy gave him 214 B. It state that he needs to provide information that was not given. He was asked what his job, he said Carpenter.( That was his previous job). He does not work anymore. The Interviewer didnt give him a chance to explain. after my dad answer that the guy give him the denied paper.  So im little worried when the 214 B paper asking to provide more information.  I told my dad next time he has to bring pictures and I will make a cover letter. Would that be enough? We are filling up the DS 160 with the same information. On his next interview, are they going to ask why he was denied? I am so worried about him falling again.

They aren't asking him to bring more information. He was refused. There is no appeal and no option to submit more evidence. The only thing he can do is pay the fee again and schedule a new appointment.

 

He should request a Tagalog speaking officer (or bring someone to the interview). 

 

They won't ask why he was refused recently. The next officer will see the notes entered by the previous officer and thus know the reason. 

 

A letter from you or pictures is not going to help. He wasn't refused because the officer didn't believe he had a son in the U.S. He was refused because the officer didn't believe he would return home after a brief visit. The only thing he can do is prepare himself to explain why he has strong social and economic ties to his country and why he won't misuse his visa.

I'm not sure what pictures he could bring to prove additional ties to his home country...? A cover letter is a nice formality, but also doesn't prove ties to his home country.

 

Yes, they may ask him about any previous visa attempts.

 

Edit: And to clarify, that refusal refers to 214b, which means they do not believe he intends to return home. They think he will stay in the US (and likely file for AOS).

I have read on other website that if he reapply quickly, he has a change of getting deny again. 

He was denied couple days ago and Im planning to reaaply today. Is this too quick to do it? How many times the embassy can deny your tourist visa?

They can deny you forever, if he applies again what has changed to make him more eligible?

Sorry , I dont know how to reply. 

 

There is no changes. I dont know what wlse to do. All I want is him to be in US to attend my graduation and meet my daughter. Is it possible if I change the lenth of stay? Instead of 6 months it would be 4?? Would this help?
