There is no extreme hardship when u both can return and live in ur home country.  It is difficult to prove when u r both LPR.  Also the new executive order says any crime is deportable.

okay i understand that is there any way that i can waive this i know i did made the mistake for comiting the crime and im stil paying for it  and plus my doughter she a us citizen

Your daughter is a US Citizen, but she is also able to gain residency in India through you and your wife. Unfortunately, the crime you committed is deportable.

The qualifying hardship would apply in a case where your wife, child, etc. would suffer extreme hardship as a consequence of your deportation. Your wife and daughter already have their status approved, no matter if you are deported. If you are the sole earner in the family and leaving would leave them unable to have any income, you might try that route (financial hardship).

It looks like your options are very limited.

Refuses to state the crime

And yet, wants advice, expects people to help. Not stating the crime doesn't change it. Doesn't take it away.  I don't think it really matters in one way. If it's so bad he can't even admit to it here, I don't think he has a snowballs, really.

I can explain it to you. But I can't understand it for you.

Crime must relate to those sexual things.

Your lawyer has no idea what he/she talks about. OP needs a new competent immigration lawyer, a very good one.

You keep shouting about your relative's citizenship, it plays no role here.

the crime is aggrivated assualt

So felony level assault? Any type of aggravated felony is a deportable offense.

Is it one of the crimes listed here?

Also, did you plead guilty, no-contest, or were you found guilty?

All super important to know.
