Haven't filed US taxes

I have a question.  I haven't filed US taxes since 2013 because I lived abroad and my husband has been supporting me/our family since then (I quit my job).  I cleared it with the IRS that I didn't need to file since I had no income.


I recently moved back to the US to establish our domicile during this process.  When it comes time for the NVC stage (which hopefully will be soon!) , is it an issue to not submit previous years tax returns?  We are't using a sponsor as we are fortunate to have enough assets to fully meet the income requirements (savings accounts, investment accounts, income properties, etc).

It could.. I know even in the US if you make less than a certain amount a year(what it is these days I'm not sure, maybe less than 10k annually?), not sure... that being said even using assets to offset the income requirements, they may end up asking to see the tax returns, even if you have nothing to show on them, just to see that you are fully current. Can't say for sure in your specific case.

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

You can order a "verification of non-filing" letter.

https://www.irs.gov/individuals/tax-return-transcript-types-and-ways-to-order-them

"Verification of Non-filing Letter - provides proof that the IRS has no record of a filed Form 1040, 1040A or 1040EZ for the year you requested. It doesn't indicate whether you were required to file a return for that year. This letter is available after June 15 for the current tax year or anytime for the prior three tax years using Get Transcript Online or Form 4506-T. You must use Form 4506-T if you need a letter for tax years older than the prior three years"

"You are required to provide your U.S. federal income tax return for the most recent tax year as well as proof of current employment. If you were not required to file a tax return in any of these years you must provide an explanation. Failure to provide the tax return or evidence establishing that you were not required to file will delay action on your relative's application for permanent residence. If this information is not provided, this will result in denial of an immigrant visa or adjustment of status. "

So, you have to provide an explanation of why you did not file. Would be attachment to the form.
