Hi, I am currently holding a K1 visa, we got married and filed the adjustment of status last december. My biometrics also done a month ago.. May I know what will be the next step and about how long before I'll receive the green card?..  And should I apply for EAD now to be able to work since I don't know when my GC will arrive.

 

does anyone applied the same time as me?.. what is the progress?. thanks, hoping for your reply..

Just out of curiosity did you know that you could apply for EAD/AP with your AOS at no additional cost?

 

Adjustment of status can take one to two years, normally within a year but it may be a good idea to check the earlier threads to see on average how long it takes people from filing to approval. Mine took 5  months.

I will not look back on this journey with fond memories, but I will look back knowing that every step was worth it, whatever the outcome.

hi slimbolina, thank you for sharing your timeline as a reference. I didn't know that I can apply EAD/AP without additional cost beacuse the time that I filed for my AOS I saw on the website that I can apply the EAD/AP at the same time but I need to give extra payment, at first I thought I wouldn't be needing it since I might receive the GC soon.

Oh no, I'm sorry you didn't know that. I know it is free for those adjusting through K1 as part of their petition, I only knew that from being on VJ. You'll have to apply for your EAD separately now and pay the cost for filing, it's up to you if you want to apply for it or just wait for your GC, it's a gamble because there's no way to know how long your AOS petition will take to be approved if you do.

You can still apply for EAD/AP at no cost. You just need to send along s copy of the NOA1 from your i-485 application.

You dont need to pay again for filing I-765 if you had already paid for AOS.

 

This is based on the official I-765 instructions as attached in the USCIS official website (page 10 of link below)

 https://www.uscis.gov/system/files_force/files/form/i-765instr.pdf?download=1

 

"If you filed Form-I485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765. You may file  the Form I-765 with your Form I-485, or you may submit the Form I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of Form I-485 as of July 30, 2007."

hi Suss&Camm and MsCompE thank you for that information.. Is this I-765 instruction was the updated one?.. but anyway, I will file my EAD asap and also the AP.  The AP is another payment right, only the EAD is exempted because I have a pending AOS status?.. Will I be repeating my biometrics if I will file these two forms (EAD and AP)?. thanks again.

The forms on the uscis websites are the newest updated ones. You will probably get another bio-appointment yes.
