Hi! 

 

1. I have my K1 interview booked for march 16. Originally I had planned to marry and adjust status to stay in the US, but I recently secured a job in Norway . My fiancé and I still have plans to marry in the US but will not apply for adjustment of status since we will be moving back to Norway after we marry in the US. Would you advise that we proceed with the K1 visa?

 

2. Will canceling the K1 visa/ moving forward with the K1 (and not adjust status) affect us with possible future visa applications?

 

3. If you do think I should cancel my K1 visa, can I go to the US for around two weeks on an ESTA and then get married and go back to Norway?

Good thing you didn't enter the us to marry and adjust status, that would've been fraud.

you don't really need to get a k1 to marry here and go back to your country, but I would go straight ahead and have the interview, since it's already booked.

You should be fine applying for a cr1/ ir1 when the time is right for you two to move back to the us

Either strategy works from a future spouse visa perspective. It should not cause any problems. Make sure you let the embassy know, in writing, if you choose to cancel the visa interview.

 

You might get scrutinized on entry to the US without the K1 and plans to marry (wedding attire in your suitcase?). But, with a return ticket and solid proof of the job and housing in Norway, that should be fine (no promises though). Worst case, you could get married in Norway at a later date.

 

Did you have your medical yet? Travel to Stockholm booked? Major expenses saved would definetively be tipping the scale, if I was in your situation.

If it isn't difficult, it isn't worth it.

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens
