Hi! So I am a Us citizen and I am engaged to a guy from Saint Lucia. We plan on getting married here and living for a bit. He already has a workers visa that allows him to visit. Would it be a waste of money if we also apply for the Fiancé visa since he already has a visa or would it be illegal to get married on the workers visa? Thank you!

Hi there. Does your BF have a work's visa or a tourist visa? Those are 2 different things. Is he living in St Lucia or in US now? K1 Fiance visas are for people that are living in another country and want to marry an USC in United States.

So it's not a work visa but a b1/b2 visa that is not an immigrant visa and it doesn't have dual intent. Coming to the us with it with intention of staying and adjust is fraud.

 

you should definitely go for a k1 visa if you intend to marry and have him stay.
