Re entering USA during initial 90 day period after K1

Hi, does anyone know the restrictions on after the K1 is approved, leaving and re entering the united states during the initial 90 day period?

either married or un married within that time. 

And if married and you leave, can you re enter easily?or do you need another visa?

Once approved and you receive the K-1 visa in your passport. You have until the expiration of your medical to use it to enter the US.

 

It is a 1 time entry only visa.  Once married and you are filing for AOS, then you apply also for EAD(work permit) and AP(advanced parole).

 

If you do not have the advanced parole and you leave the US, you will not be allowed back into the US.

You can leave the US anytime you like. 

 

If you get married and you leave without having the AP (you file for AP when you file for AOS) and you decide you want to come back to the US to live, you have to file for a CR-1 visa. It takes roughly around a year to get it, you can't live in the US until you get it.

 

If you don't marry and you leave you can file for the K-1 again. You can't live in the US until you get it.

 

If you want to return to the US as a tourist only you file for a B2.

K1 is a one entry visa.

A K-1 is a one-use entry visa.  If you leave under any circumstances, you will need another visa to re-enter the US.  A spousal visa would take a year.  You can not use a tourist visa to enter with the intent to immigrate.

 

After marrying, you can file for AP with your AOS.  AP takes about 90 days after you file for i.  WIth AP, you can leave the US and return to continue processing for your green card.  If you leave without AP, then you will be deemed to abandon your AOS.

If you enter the States on a K1 visa and then leave, you cannot re-enter. You will need to reapply.

 The K-1 Visa Holder will need to apply for Advance Parole (AP) if they wish to travel outside of the US while their AOS application is being processed and not yet approved. Leaving without an approved (and in hand) AP will result in abandoning the pending AOS application and require filing for a new visa (either K-3 or IR-1/CR-1) to re-enter the US.
