K1 visa question

My fiance is, and there are many, many Filipinos on VJ. It is even be the most common nationality here by far (416 K1s from Philippines in the last year, compared to 239 from the UK, the 2nd highest here). Welcome.

 

Besides a general "the odds are pretty good", it's really up to the individual's circumstances. Does your fiance meet the requirements for the I-129F petition (including meeting at least once within the past 2 years)? Do you have proof of a bona fide relationship? Can you meet the other requirements & obtain the necessary documentation? Do you have any red flags? Have you been denied multiple visas in the past? All those factors, and more, play into the result.

 

That said, unless there is a reason for denial, generally K-1s are approved for real relationships. I can't say it always happens, but it's a rare occurrence that somebody who qualifies for a K-1 and has a valid relationship is denied.

we have 7 photos of eachother for the petition and she has a passport with stamps and i have a copy of my orders so we have proof of when and where we met. We have proof of ongoing relationship from facebook chat messages and sge has receipts of money i sent to her. Also she has proof of an engagement "congratulations" message from my mother that she printed out..you think i have a good chance?

The passport stamps are fine. Photos together are fine as long as they can be verified to be within the 2 year prior to filing of the I-129F. Boarding passes are good, too. It sounds like you're good there.

 

The ongoing relationship piece will be necessary for the K-1 visa, not the I-129F. Facebook chats and such are good. The more you have, the better (but be reasonable). Money being sent isn't proof of a relationship. Anybody can send money to somebody else. If you do any video chats (i.e. Skype or similar), screenshots can be nice as well. That said, they will want proof between the time of filing the I-129F and the K-1 interview as well (to ensure it's an ongoing relationship...and you didn't break up or something and still try to get the visa).

Manila isn't a particularly difficult embassy. I wouldn't worry too much.

To keep it simple, every situation is different. Even so, The Philippines (historically) has been a very easy country from which to get a successful K1. Keep in mind that there are multiple layers of bureaucracy to sort through in the Philippines, but nothing that should prove overwhelming and impossible. You can PM me for additional guidance.   • First, make sure you are both eligible for the K1. Begin here (http://www.visajourney.com/content/guides/).

  • Subscribe to the Philippines forum(s) and get involved (http://www.visajourney.com/forums/forum/129-philippines/)
  • When you finally submit your I-129F petition, front-load it with evidence. There is no such thing as too much.
    • EXAMPLES: Passport stamps / Boarding Passes / Tickets of Travel / Hotel Receipts / Photos / Phone Logs / Messaging Logs

 

Can you successfully answer YES to the following questions?

1. Are you and your fiancé legally free to marry?

2. Does your income meet / exceed the federal U.S. poverty guidelines by 125%

3. Assuming you are filing soon, have you and your fiancé personally met within the last two years?

4. If either of you were married before, do you have supporting documentation showing the marriages were annulled / dissolved?

 

If you answered YES to the questions above, and there are no hidden / pending legal issues preventing you from petitioning, you are good to go.

Fall 2014: Dyn returns home to Philippines after seven years in Kuwait

ANNULMENT

February 2014: Engaged while I visited Philippines

March 2014: Officially hired attorney and filed for Dyn's annulment in Bohol, Philippines

December 2015: Bohol District Court issues decision in our favor

December 2015: Judge sends transcript of his decision to OSG for processing

February 05 2016: OSG returned receipt and approval to district court in Bohol. CoF to be issued end of second week in February

February 09 2016: Dyn is presented with the Entry of Judgment and her Certificate of Finality via the local court.

February 15 2016: LCR issues annotated marriage certificate, and necessary documents are forwarded to the NSO / PSA visa LBC

April 19 2016: Received CENOMAR and Annotated MC from PSA via private courier. DONE! COMPLETE! FINISHED! OFFICIAL!

I-129F / K1 VISA APPLICATION PROCESS

April 04 2016: I-129F sent to Texas Lockbox via USPS Priority Mail

April 12 2016: Email from USCIS acceptance confirmation

April 17 2016: Official NOA1 hard copy received

July 12 2016: NOA2 Approval hard copy received

July 14 2016: Post Decision Activity email from USCIS

THE LONG WAIT (USCIS misplaced approved petition)

September 16 2016: NVC received approved I-129F petition and assigns case number

INTERVIEW / MEDICAL PROCESS

October 04 2016: Day 1 of medical at SLEC in Manila

October 05 2016: Psychiatric evaluation off-site due to psychological incapacity annulment (10 hour eval with 800 question profile test)

October 13 2016: CFO Seminar completed successfully and certificate awarded (CFO stamp not issued until visa is presented).

October 20 2016: Return to SLEC complete psychological evaluation with resident psychologist (less than ten minutes)

October 21 2016: Vaccination day at SLEC (medical finally complete)

October 25 2016: Visa interview at USEM in Manila (APPROVED)

HOMECOMING

November 19 2016: Dyn's arrival at POE Dulles IAD in Washington DC

December 01 2016: Married

Haha thank you, its just hard since im in yhe military, i cant really easily travel to the Philippines for tourism reasons to get more proof of relationship. And ita hard to proceed with marriage plans until this visa gets approved so im stressing out a little bit. We have proof of a relationship but we dont have to many pictures, only a handful but we definitely have proof of ongoing relationship. Everyone says manila is pretty easy to get approved but still, i would just like to know how easy

Nobody can answer "how easy". That's relative. What I would call easy might be hard for somebody else. But it is an "easier" one IMHO.

 

Front loading evidence of a valid relationship isn't needed for Manila. It usually doesn't hurt, but it's not actually necessary like some embassies.

Keep in mind that photos are considered secondary forms of evidence. They are very helpful, and will likely be reviewed during the interview, but for the sake of petition approval, just a a few are needed.

Got approved last week @manila embassy  it's easy when everything is ready specially the documents and the person itself is aware of everything about you. Good luck :)

You're very much welcome. What Stressed  me out is the Medical ??? but all and all Just keep the faith and Pray. Keep busy getting the documents needed.Visit Thier website and it'll help you prepare of everything you must bring.
