Was wondering if anyone knew about the i-134 affidavit of support in regards to the sponsor of the form as I currently live with my partner in another country, but once our k-1 visa gets accepted we will be moving to USA (i'm a citizen) to live and get married. I am just uncertain if I put myself down as the sponsor or if I can use my mom because at the moment I don't have a job in the USA, just in the other country where we are currently living. I know you need payslips and tax returns from the USA and stuff from your employer, but like I said before I don't have a job there yet. Any help would be much appreciated.

You can use anybody who is willing and has US domicile. Note that domicile does not mean residence. For information on how to prove domicile, see here:

That said, anybody who meets those requirements can be the sponsor. Once you enter the US and your fiance files for AOS, the I-864 requires you (as the USC spouse) to be a sponsor. You will need to have US domicile at that time (even if you get a joint sponsor).

 

Quick question, though - you mentioned that you live with your fiance now. How long? What is the reason for not getting married abroad and then doing DCF instead? It is much, much faster (weeks to months) and cheaper than a K-1.

Thanks for your information. We currently live aboard and I have lived here with him for nearly 5 years. We want to get married where I am from in the states.

 

So would I put my current job of where I am living abroad on the I-134? I know for the I-864, I can have a co-sponsor, and I will have US domicile and job.

Alright. That's certainly an option available to you. I was just suggesting DCF since it's available to you and will save over a thousand dollars in fees, and takes weeks to months, instead of the 6-8 month K-1 process, followed by the 8-10+ month AOS process. And the odd 3-9 month period of time where your fiance is in US without being able to work or travel abroad.

 

You should complete all forms using the information as of the time you submit them to USCIS. So if you work abroad now (and still will be when you file the form), then that's the information to use.

Yeah so my partner put his work here in Australia down and income and payslips etc as well as his last 3 years of US tax returns. Then we got a co sponsor in the US to fill out another I-134. So essentially we submitted two I-134 forms. I was never even asked about it. But the interview was easy and we are off next month :)
