Hello all!

My now husband entered with a K1 visa in November. We married in December, and we are about to apply for AOS this week. My question is this... The 90 days will be up in a few days. We got married within that time. What type of protection if any does he have while waiting for EAD and AOS approval? With the latest raids taking place and traffic stops that have transpired in the last few days across the country, I'm left wondering what should he carry on his person indicating his status which is basically married and waiting for the next step?

Hola AmGe!  Even though your husband spouse if protected under his K1 visa, and subsequently you legally registered December marriage, I would have him carry a photocopy of his marriage license, and photocopies of any other legal document(s) that substantiate his marriage to you, and a photocopy of your US Passport biometric page (the one that has your photo and detailed information. Likewise, if you have applied and submitted the essential paperwork for his EAD and AOS it wouldn't hurt for him to carry photocopies of those forms also.  It would be advisable for him to avoid public areas where it is known that illegal aliens might normally congregate or socialize. Any and all precautions are prudent until he has his legal documents.  Buen suerte.

Thanks for the response. I've been thinking along the same lines regarding carrying all that paperwork. With all the uncertainties as of late, it really caused me to really think how are spouses protected, if at all, after the 90 days and the visa date expires. Gracias por su respuesta.

You will have a greater chance of going through a check point the closer you are to to Mexico border.  It is always better to have the proof and not need it than to need the proof and not have it. I like the idea of taking pictures on your smart phone just in case.  We are in Atlanta and going through ROC.  My wife carries her (now expired) two year green card and the one year extension letter.  We are praying her ten year green card gets approved any day but will do an info pass to get the 551 stamp if no word from USCIS when we get close to the expired date of the one year extension.

Good luck to you! We are just getting started with AOS so we have a ways to go.

My wife is from Mexico City and we travel there at least two times a year to see her mom and brothers.  We used to fly via Delta non stop from Atlanta to Mexico City for around $350 round trip.  Over a year ago Delta increased the price to around $800 round trip!  We now fly Southwest with a stop in Houston for just over $300 round trip.  We do not mind taking a few more hours when we are saving so much money on flights.
