Timeline

Hello. I've got a question. I am getting ready to submit a I-129F for my fiancee that lives in Mexico. My question is if she can travel to the US (on a tourist visa) if the I-129F has been approved but before she goes to the pick it up at the US Consulate? Could someone please let me know? Thank you!!!!!

8/30/07: NOA1 received (I-485, I-765, I-131)(Day 33)

1/9/08: AOS Interview (Day 165)

1/9/08: RFE, need to provide I-693A (Day 165)

2/7/08: I-485 Approved (Day 194)

Just wondering about a few things from your post....

Do you mean once the K-1 Visa is approved or really the I-129F? Because the I-129F is just a petition and there is still a process to go for her to get the actual visa.... Please clarify!

When she gets her actual visa, why wouldn't she just use it and come over for good?

During the process of obtaining the visa she can visit the US as long as she can prove her intention to return home until the visa is approved.

Timeline:

11-15-2005: Sent in I-129F to VSC

11-21-2005: NOA1

11-29-2005: NOA2

12-05-2005: NVC recieved

12-17-2005: Packet 3 received from Dublin

1-11-2006: Sent packet 3 forms, etc. to Dublin

2-03-2006: Interview Date :)APPROVED!!!

2-05-2006: Flying to Logan Airport

2-11-2006: Wedding Date

3-14-2006: Filed AOS and EAD

3-22-2006: NOA1 (AOS and EAD)

4-07-2006: Biometrics

6-07-2006: EAD approved!!

7-24-2006: AOS Interview APPROVED!!!

7-27-2006: Received Welcome to America letter

8-03-2006: Green Card Received :)

Well, here is the situation. We are getting married in Mexico (but not the civil portion) and would like to take a honeymoon to the carribean. As all of the cruise lines depart from a US city, she will have to enter the US. If she has an approved K1 visa, then she will not be able to leave the country to go to the Carribean. Therefore, I was thinking that we would send in the I-129F and not pick up the K1 Visa from the US Consulate in Mexico until we return from our honeymoon. Your thoughts?

When are you planning the non-civil part of the marriage? (and just a heads up, be careful with that... even though it is not a legal wedding, if for some reason the immigration officers mistake it as one you will have trouble)

After sending in the I-129F there is a long process before she actually gets a visa so you could probably do all that in the middle. Have you looked into the process for K-1s in Mexico yet? Every country does things differently. Some people get the visa immediately on completion of a successful interview, others get it shipped to them. I think you need to find these things out (by reading the guides, consulate websites and asking questions) before you make any plans!

But once she actually has the visa, I don't think she can use a different one to get into the US. I could be wrong on this as we never even looked into it, but think that I have heard once you get the K1 you can use it and only it.

We're planning on having the non-civil wedding in April 2007. I just wanted to start asking these questions now. Thanks for your help J&JS. I'll have to try contacting the consulate down there.

You'll most likely have the K-1 approved and the visa issued prior to April 2007. Most people around here seem to get the fiance visa in less than a year, although I'm not sure on the time specifics for Mexico. The I-129F petition will almost certainly be approved by that point, and it will be at the US embassy in Mexico being processed.

Would you fiancee even be able to get a tourist visa? A lot of people from non first world countries have hard times getting tourist visas to the US, especially when there is a K-1 visa pending.

Not to burst your bubble, but you might just be better off waiting for your honeymoon until after she's here and you get the AP (advanced parole) after filing for the EAD.

By your April 2007 timeline, you probably can already have a civil marriage in the USA before the non-civil marriage in Mexico. If you apply for a K-1 visa now, you will most certainly have it in 6-9 months. Then, she can arrive in the US and have a civil marriage late this year. Then, apply for advanced parole to leave the country and go to Mexico for the non-civil marriage. Applying for advance parole can take 2 or 3 months. To go on a honeymoon, you would need to apply for 2 advance paroles. The first is to go to Mexico for marriage and the second is to go to the Caribbean after arriving in the US again.

02-23-2006 USPS online confirmation of delivery.

02-24-2006 NOA1 (received 03-02-2006).

02-28-2006 Touched - first time.

03-01-2006 Check cashed.

No You can apply for a multliple entry AP and use it a couple times in a year.
