I'd just like to share my experience in getting my learner's permit...

THe drivers dept service office here in GA did not let me to get a learner's permit..they are insisting that i am not eligible to apply for one since i am under the temporary employment thing...i said i am not under that category since i came here in a K1 visa....i even showed her the information i got from their website that non-US citizens can apply for one by presenting one of the ff immigration docs which is one is the unexpired I-94...the date indicated in my I-94 is dec 22, 2007...meaning it is not expired yet...i told her that i got married already and i got all my papers sent to the uscis...but she still insists that temporary employment thing and that i need to present an "extension letter"..what the heck is an extension letter for us under the K1 visa? i would greatly appreciate if somebody can enlighten me on this and can help me on how this works...

having said this, does this mean that i need to wait for my EAD card or Greencard to apply for just a learner's permit???

thank you very much!

Hi Sheriff,

I cant exactly tell from Sect. 1.1 the status between expiration of I-94 and AOS approval. Does this mean that it is statusless???

thanks.

Please reference the Adjustment of Status - Forms and Tips for K1 Visa Beneficiaries [CLICK HERE] just for the AOS tips. The beneficiary can apply 10 - 14 days after arriving to the US, but no later than 21 days before the I-94 expires for a social security card, driver's license, or State ID. I'm not sure whether it's a policy, regulation, or immigration law but it is absolutely certain there will be a cease and decise on processing any of the three before or after the specified window of opportunity previously mentioned. Hopefully someone has a reference or you can do the leg work yourself and let us know what you have discovered.

I cant exactly tell from Sect. 1.1 the status between expiration of I-94 and AOS approval. Does this mean that it is statusless???

Until the AOS is approved the beneficiary’s status is nonimmigrant. Once the AOS is approved, the beneficiary’s status will be legal permanent resident (LPR) A.K.A “Permanent Resident.” However, you will only be issued a conditional two year greencard until, if you have been married less than two years. Then 90 days before your two year conditional greencard ends, you must apply to lift the conditions of residence to receive the normal 10 year renewable green card.

When can I apply for a current passport under my married name??? Is this really required for now??? ...WHERE can I apply? ...

You can apply to amend your passport to state your married name as soon as you receive your certified marriage license. No, this is not required for any aspect of the immigration process. Meph started a thread which has references cited by other members on where you can apply to amend your passport to your married name [CLICK HERE]. Amending your passport is also not required to travel outside of the US. However, if you do not amend your passport to your married name, then you will have to carry a copy of your marriage license when traveling outside the US in order the validate who you are at the POE.

NOTE: Do not travel outside of the US until you have received your advance parole or greencard because you will not be permitted back into the US otherwise, which means that you will have to start the visa process all over again as a K3 visa.

you asked how many you need 2 identical photos 2"X 2" passport size for I-485 application, and if you're applying for EAD as well then you need another 2. you may want to refer on this link about I-485 Instructions (#4)
