K1 Immigrations Stages (Simplified and Theoretical)

Based upon my research, there are five stages in the K1 immigration process:

1. Petition Stage (required)

- US Citizen (USC) petitions to bring the alien fiance(e) to the United States. Petition is approved.

2. K1 Visa Stage (required)

- Alien fiance(e) submits visa applications, supporting documentation, takes a medical exam, and attends a visa interview. K1 Visa is approved and issued to the alien fiance(e) or "Nonimmigrant" permitting travel to the United States.

3. Adjustment of Status (AOS) Stage (required)

- Alien fiance(e) or "Nonimmigrant" arrives in the US, marries petitioner (USC) and files for AOS within 90 days. Some applicants may be scheduled for an AOS interview. AOS is approved. Green Card [conditional one-time two year expiration if married for less than two years] is received and status adjusts from "Nonimmigrant" to "Permanent Resident."

4. Lifting the Conditions of Residence Stage (required)

- "Permanent Resident" and USC file jointly to remove the conditions of residence. Condition of residence is removed. "Permanent Resident" receives Green Card [renewable ten year expiration]. Status remains "Permanent Resident."

5. Naturalization Stage (optional)

- "Permanent Resident" has the option of applying for US Citizenship [naturalization] after three years of being married to a US Citizen (one year after lifting the conditions of residence). Applicant attends a naturalization interview. Naturalization is approved and the issuance of the Certificate of Naturalization officially adjusts the status from "Permanent Resident" to "US Citizen."

If she can't get her conditions lifted after 2 yrs because I'm not in her life, then her visa status would be terminated?

Which would relieve the co-sponsor of olbligation?

Technically, I think the answer to that question is NO. Plenty of illegals have obtained govt. benefits. Practically, if she's no longer in your life, I would suspect she'd probably be out of the country, thus relieving you and co-sponsor.

That's how I understand it. the obligation would end when she left the country. on the brighter side and you have a happy life together , the obligation for you co-sponsor would end if she becomes a US Citizen. that could be in as little as 3 years.

hope we'll soon receive good news from DocMay and george&jenny on the results of their interview.

Can we attend both the CR1 and K3 interviews? If so what might the outcome be? Our K3 is May 16 and our CR1 is May 30. We want the CR1, but were told we could go to the K3 and request the CR1. With a CR1 interview pending is that wise of us to do still? Or just wait? We'd certainly LOVE to get back to the US sooner and if we can secure the CR1 on the 16th would be great.

Also, if they issues a K3 on the 16th and not CR1, can we still go on the 30th and get the CR1???

I feel so behind the curve, not even sending my packett to USCIS yet.

Ayayay! What are you waiting for? Send it out before the two years since you last saw her is up. You don't need to show income upfront when filing the I-129F. Income will be required 6-8 months from now during the interview. By that time, you're well above the poverty level.

If it's been two years and a day since you were in the Philippines, you will need to come back here to satisfy the requirement of having met within the last two years. I'm not even sure how USCIS will count the days when you last saw her ~ date of receipt at USCIS? or date of adjudication? For example, if you saw her last on May 15, 2005 and then you send in the I-129F on April 15, 2007 which is still within two years, but at the time USCIS adjudicates the case on July 15 (assuming you are processing through California or Texas), then it would have been 2 months after the 2-year requirement. Then, the adjudicator may have a reason to deny your petition. When was the last time you saw her by the way (month and year).

Will this affect the approval of her visa? I am not going to the Philippines until next month...I'm worried :unsure: Please assure me it's going to be okay.

Kimtung also had their K-3 and CR-1 only a few days apart. they attended the K-3 and were advised by the CO to pursue the CR-1, which I beleive they did. I don't think you'll be interviewed for CR-1 on the 16th. you'll have to go back on the 30th for that interview.

Oh bother! Fely's having trouble getting documents again. She went to her local town to get her police certificate so that she can send all her papers to me and I can send them on to the NVC. After 2 hours waiting she was told the police chief had an emergency and couldn't sign her certificate right away. She's off to Manila tomorrow, so I told her to just forget the police certificate and send me what she's got. She'll send them once she's in Manila, and she plans to take her CFO seminar later this week. I hope that goes better for her than other things lately. Meanwhile I still haven't received the letter from the NVC telling me what documents I forgot to send with the I864 package.

hello.. jas wanna is it ok if i purchase only a one way ticket? i called up a one travel agency then i asked her about the price of a certain airline for a one way ticket only. However, she said i should take a roundtrip ticket even if i am on fiancee visa because the immigration will not allow me to leave the country holding a one way ticket only...i need your help. i was about to pay the one way ticket today but then this travel agent told me to purchase the round trip ticket. thanks.

Jackie, I responded to your PM but I'll say it again here. The travel agent lied or just does not know better. You CAN use a one way ticket. A good friend of mine came on a one way ticket in March. (she was K-1)

This one really alarmed me: http://www.visajourney.com/forums/index.php?showtopic=63240 as David and I have huge age difference (he's 62 and I'm 28). I will be his 4th wife. He's twice divorced - 1st and 3rd marriage and the 2nd wife died of a certain illness, but it is the first time that he filed for a K1. I've been worrying about our age difference because other says it's a red flag and I will be scrutinized during the interview, while some says it won't affect the approval of the visa as long as my petitioner can meet 125% poverty guidelines and we have all the necessary documents to prove that our relationship is bonafide. I've never been married, no kids, never traveled abroad so there's no way that I'll have a problem on my part... The age gap thing is what concerns me more (just now after reading Doc's post) because of cases being put on AR / denied.

Guys, please enlighten me... Should I really be concerned and worried? And one more thing, is it very likely that a CO can deny a visa just because he's not feeling well and having a bad day??? See, I'm getting paranoid. :blink:

Anyone here who made it through despite the huge age gap? I really need some inspiration...

I wouldnt put so much power on the cogress womans shoulders there my friend.

They have no power over the visa process other than making enquierys about the status of your case.

Its more likely that the administrative process was complete and they just finally processed the visa for you.

I am glad to see you finally get your visa,we got the same delbros info today as you did and we been on AR since 2/27 and i didnt contact any congress or any outside help other than calling on occasion and checking the status myself.

Sometimes the AR is for simple name checks and NSO documents being verified.

Good luck with the rest of your journey,i am now making flight arrangments so i can go get my babes first week of May :)

The travel agent is applying Philippine Law to another country. Unless you are an LPR or balikbayan or Philippine citizen you must have a round-trip or onward ticket to enter the Philippines.

I know, I know, some are going to say they know someone who didn't have another ticket out of the P.I., but that is the law and they can refuse entry if they want to. It has happened.
