Yardies, at home and a farrin' (Part 4)

OK guys.....I want to talk serious here for a moment. About something that has recently happened in my life. I tell you this in hopes that it can save someone else some pain and heartache in the future.

My husband lost all sense of....well, all common sense, in June and decided he needed a pair of shorts bad enough to shoplift them from J.C. Penneys. After the fact, I found out he had been watched going into the dressing room with two pairs of shorts, coming out with just one. He had been followed out of the store. A mall cop ran after him and chased him I'd say a quarter of a mile, at least, to a nearby restaurant, where they found him in the women's restroom and the shorts in the trash can. He was not arrested nor fingerprinted (thank God). He went to mall jail, got a summons, and was relesaed. Of course, I blew a gasket at the news.

I immediately contacted a lawyer friend of mine who got us in touch with a criminal attorney. And, of course, I researched the laws regarding immigration and this issue. I really write this today because when this happened, I asked on this board and no one had any answers. That was scary to me. According to my research, as long as he spent less then 365 days in jail, he would not be deported. However, when readin g the forms for use when we apply for his 10 year green card and then later for naturalization, they don't just ask if he has ever been arrested (NOT), they ask if he has ever been detained or charged. A completely different thing. I was scared.

Fast forward to last night.......after 2 continuances and a conference with an immigration attorney, Andre pleaded down to trespassing and fined $100 plus $62.50 in court costs. After the initial shock of our lawyer saying he thought the fine would be $500-1,000 and could involve community service and a bigger charge, I was relieved to say the least. The immigration lawyer also said this would be of no impact on any future immigration issues.

After celebrating our good fortune, I ended with reminding my husband that those stupid pair of $40 shorts still ended up costing us $662.50 and the next time he plans on spending that much, it better be on something with the Louis Vuitton logo on it for me.

Just a word of warning all.....some little mistake that was done in a moment of weakness could end up sending your entire world crashing down around you. it is more important as immigrants. Please remind your SO of this. It could be shoplifting. It could be drunk driving. It could be drug charges of some kind. Whatever. Remind them of how important it is to keep themselves out of trouble.

Wow JG...I am glad it all worked out in the end and won't affect immigration at all. Sorry you had to go through it all. Good advice...even the smallest thing can affect immigration and it is nothing to mess around with.

Wow, Jomo...first of all, thank you SOOOOOO very much for sharing that. You didn't have to and I respect the fact that you did, in the hopes of sharing your knowledge. That took a great deal of courage! Second of all, THANK GOD that it ended the way it did! Don't stop sending blessings for that. Finally, WOW, what an eye-opener that is for me. I will definately keep that in mind, cause you are right a 1-second decision, can effect a lifetime of happiness!

Wow... This is crazy.

This reminds me of my niece who moved to Canada recently. She went into a store called Zellers, took a home pregnancy test from one of the shelves, went into the store rest room and used it. Well, she was caught on camera and arrested. Luckily for her that my dad, and ex cop, had been outside talking to one of the mall police officers - the same officer that was later called to take her to the station. When they found out that she was related to my dad, they decided to just let her pay for it and forget it had happened. They did ban her from entering the store for a while though.

I can't see how I could allow something like that to happen to me. It's already so frustrating to have ppl following you around stores. There's no way that I would give them actual justification for it. I will not have anyone pointing fingers at me saying that this was the person who did this or this was the one who did that.

Anyway, sorry about the rambling. Thinking about these things just pisses me off sometimes. I really do hope that this does not affect the rest of the process for you and your s/o.

Just an FYI to all...we ALL have an internet signature/identity even if you post on Yahoo Gorups. Nothing in cyberspace is completely private so if you are worried about cyber identity its most likely already been compromised. I work in this stuff daily and its amazing the stuff you can find on someone with a little effort online.....sorry don't want o scare anyone :blush:

But I think I remember Jonesie having a girl use her pics on mypace...that was ridiculous.
