at lost with k2, help!!

We're on k1 and k2 but we are kinda at lost with k2, I dont see much info here about k2. My fiancee wants to adopt my son who is going with me at the same time. Question is, when we arrived in the US do we need to adjust the visa of my son too? and what do we need??? and anyone have gone through adoption process of a k2? please give us more info on how to go about it... thanks!!

I don't know too much about it since I didn't do it, but I can tell you this:

Yes, you WILL have to adjust the status of any child that comes with you, just as you will your own and

the whole adoption process has nothing to do with USCIS. That is something you will deal with through the court system where you will live once you arrive here and you are married. (Well, you wouldn't *have* to wait to be married, but I'm assuming you would.)

You are right, the K2 information is thin and hard to find. Some suggestions I would have for you is to be sure and get all vaccination records for your child, including those that you get at the immigration medical appointment. Bring the original birth certificate for your child.

You (or your fiance) will file for your AOS and the child's at the same time. Make two different applications (I485) and send them in the same envelope. USCIS will figure it out from there. Your interviews will be scheduled for the same day and time. I have not done the adoption process, but I would wait until after the AOS process is done so you do not complicate matters. This is just my personal opinion.

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

From an initial petition standpoint there is not much to do for a K-2 other than list the child on the I-129f. Once the petition is approved then the process is going to be very similiar to yours. What is commonly referred to as Packet 3 will (or should) have all the information you need to include the K-2. For the most part, you will file the DS series of forms with the embassy for the child much like you will for yourself, the child will require a medical exam and you will pay a seperate visa fee ($100) for the child as well. Some embassies will require the child to attend the interview, others will be dependant on the age of the child. For me the required age for attendance is 14. Check the Embassy website to see what kind of information they might have listed.

The DS forms have to be done at the same time for the child as for the adult even if the child will follow later?

You will be required to fill out the DS forms for your children too.

They will be required to have the medical exam just like you.

Your children will have to be with you at the interview.

I'm not sure if the DS forms will need to be filled out if the children will follow at a lter date.
