Hi Everyone,

My wife and I are in trouble. When we had our original interview, for some reason we both got the impression that the government would mail us with information about obtaining the 'permanent' green card. We found out my wife was pregnant in December, and all of that excitement made us forget all about it.

Now I've figured out that the govt won't be sending us anything, and that we have to remove conditional status.

Her two-year card expires tomorrow, the same day we will send the i-751. Are we in big trouble? Please...any advice is much appreciated.

You will be technically out of status until USCIS receives your I-751 application.

After they receive the I-751, you will receive an NOA that will extend the conditional GC for one year, with work and travel authorization. The NOA usually arrives within a month after they receive the application.

Until the time you receive the NOA, your wife cannot work or travel outside of the U.S. and re-enter.

Thank you for the information. My wife is pregnant and working with autistic children. We really can't afford for her to lose her job and/or her insurance. Should she just keep quiet at work?

Fortunately, because of the pregnancy, we're not planning to leave the country anytime soon.

Regarding that UPS option...it's over 400 bucks! We can have it there by Friday morning (one day late).

I found this on a site... it might be a good idea to do this...

If you file your application too soon, that is, earlier than 90 days before your conditional residence expires, application will be sent back to you. Remember that you need to file up to 90 days in advance, and 90 days is always not the same as 3 months. If you are late only by few days for few weeks, mail the application with a cover letter, explaining the delay.

Yes, I included a paragraph in the cover letter about submitting it the day of expiration. The person we had the original interview with in LA had us both believe that we would be receiving some sort of documentation about the need to schedule a new interview. Then I come to find out that you have to do it all yourself. A bit ridiculous, but hopefully nothing bad will happen for our mistake.
