I am planning to file for a K-1 visa for my Filipina fiancee.  I don't know whether I should get an attorney to assist.  I have some questions that perhaps this forum can answer.

My fiancee has 20-year old child who we will not be seeking to bring to the US.  Do I still need to show this child's information on the I-129?

Do I have to prove ability to provide support with the I-129?  Do I have to complete any forms like the I-864 or can I merely attach financial information?  Meeting the threshold is not an issue.

Thanks.

In my humble opinion, you will not need an attorney to assist you. i'm quite confident that the wonderful and helpful folks right here on VJ can answer most if not all your questions!

The child's info will be needed for the I-129F, although in my eyes a 20 y.o. is an adult.

The financial portion of the process is not needed at the time of the I-129 F

I hope this helps, good luck to you and yours..

Going through the K1 process is expensive enough without hiring a lawyer! The process really isn't complicated but it is time consuming. I recently sent the petition application and spent HOURS researching, preparing, printing, reprinting, organizing, etc. Again, not because it's hard but because you want to make sure to turn in a thorough and complete file to avoid a RFE.

From what I've read on the I-129F is that the only time you need to list children is if you are petitioning for a visa for them as well. The financial information is needed for the embassy interview, which comes after the petition.

Best of luck to you!
