I-864 tax returns

Hi, I was wondering if using my filed tax returns would be suffice for the I-864... even if it was earnings from out of the country. 

 

Also, once the I-130 is approved what is the next step? Can I delay the process after that if my spouse is not ready to relocate? We are thinking of filing the I-130 first since I, the sponsor, would need to file that myself. Then, I plan on heading to the states with the kids first and my husband will do all other filings on his own.

You need to show that you have a present job in the US with continuous income, unless the income from foreign sources will continue and you have proof of that. I also just yesterday saw an RFE for a person on here who only sent transcripts since they had had their job for years and was well above the poverty line. Further, even if they say that you don't need to send w2's and tax schedules if you are sending the transcripts I've also seen ppl get RFE's for this, more often if they are self-employed but also if they were not.

 

What I would do is send transcripts/or 1040's WITH w2's and/or tax schedules when applicable. This will be to show PAST income and that you filed your taxes which is a requirement. On top of this I would AT LEAST send last 6 months of pay stubs and a letter from the employer (stating all the recommended parts). This will be to show ongoing and future income. I think this will be extra important at this time of year since the last years taxes are not yet required, so the required filed taxes really show income that's quite old. The evidential burden  is on you, so don't send minimum unless you wanna risk that RFE.

Also, about the i-130, it has no time limit., So I believe you guys can file the CR1 when you are ready to. Bare in mind it takes about a year to process the CR1 though.
