The USCIS directions on the i-129f form at least in one section are lame. I am completely disappointed in their service in general and about a third of the people I talked to on the phone were completely rude. The lack of instructions for a simple form question caused me to get an RFE which has takien them now what will now be over 3 weeks to respond to. I figure it might take 30 minutes to respond to and then send it out or maybe two three, or four days to respond to and then send it out so like maybe 8 days total. But somehow after taking five months to just look at my application, now they're taking 3 weeks on a step that like I said should only take at the maximum 25 minutes or 3 days. I don't really understand why if they ask you to sign to prove that you'll take care of your fiance financially, duh,  and you're still under the jurisdiction of the United States law, why they can't just hurry the bleep up and get me on to the Visa and Embassy process. I am very very very disappointed in their ignorance in provinding incorrect and or deficient form instructions and their providing what seems to be misleading directions and slower than glacial administrative  processing as well as a portion of customer service representatives that rival labatomized tyrants.

I had a conviction from 20 years ago,  that under the International Marriage Broker's Regulation Act qualifies as a conviction for which you must submit court records including police reports and court dispositions. The crime involved breaking a restraining order. There was no violence involved in the breaking of the restraining order. But breaking a restraining order no matter what, is considered domestic violence!

 

I asked my local County Criminal records department for the records and they declared that they were destroyed. They had nothing for me. I asked my local municipal courthouse where the hearing took place for the Criminal records and they declared that they were destroyed and not available. They issued me a certified letter saying so much. The letter was stamped with the official court seal.

How are you supposed to provide these documents if they've been destroyed and the court says so and they're not available?

I did what these instructions said.  I mentioned the conviction, docket number, a YP code, and final disposition.

 

Then,  5 months later I get an RFE with new instructions.

Please submit certified copies of court records identifying the complaint and the final disposition for every conviction. The final disposition should be obtained from the court where the hearing took place. You may submit original documents, or certified copies which must include the relevant Court seal stamp. 

 

Yep the court disposition is not available you must obtain a certified letter from the court stating that there is no record. You may submit original documents establishing the non-existence of Court records or certified copies which must include the relevant Court seal stamps.

 

Why the USCIS did not mention this on the i29f form instructions or on the i29f itself 5 months ago when I first filled out the application is beyond me I find this to be grossly negligent. Now after sending in the court certified statement that the records were not available I'm waiting 3 weeks and I've heard nothing. If you compare the three paragraphs of instructions the original from the i29f PDF for instructions and the instructions on part three question to a through C on the form itself and the instructions on the rfe they don't Jive. What a waste of time and what negligence.

Helo how are u? I hope u got ur visa approval. By the way. Did u file fora K2 visa? If yes how old is ur son? We receive our NOA2 but 1 thing makes me worried is that name if my mu it din which was included in 1-129F dies not appear in The notice. Do we have same situation? Pls let me know if u were able to get a K1 & K2 visa

Thank you everybody for your kind words, the moment of truth will likely be today when he goes in. I was under the impression that if he got a new job that it would reflect bad on him only being in a new job for only maybe a month or two once i get to interview stage, I managed to speak to someone yesterday who like @RaptureSongbird said, it wont affect us as long as his new job is over the poverty guideline. I can't tell you how much of a relief it was to hear them words!! My fiance really wants out of his current job for obvious reasons and so do i, i can't stand seeing them treating him like he's dirt on their shoes, I get infuriated by it and i don't even work there! So he's going to start looking around for something better now he knows he's able to do so :) 

Again thank you everybody for the support, i honestly don't know what i would do without this page!

I'm glad he's going to look for a new job because his current employers do sound awful.

I'm hoping they receive yours today.  Over the weekend I was going through the forums to look for information on what to do if it takes longer than 6 weeks for the NVC to receive your case.  While I was reading through topic after topic on this, I saw someone mention that they were advised to call on Wednesdays and Fridays because that is generally when applications are received at the NVC from USCIS.  I don't know if this still holds true (topic was from last year or the year before I think) but I'm hoping you get the news either today or by the end of the week!

VJ friends, quick question. 

 

Our case arived at the Moscow embassy today and they have already emailed us a user name and Pw to schedule an interview. Do we have to wait to get packet3 or any other email from them? DS-160 hasnt been filed out yet either. We just do not want to jump the gun and do something wrong.

Same here,I don't know if we supposed to call embassy or wait for e mail. We have been waiting for 2 weeks. No news for 2 weeks from embassy

Hello! Our case was received by Moscow embassy on July 3, at NVC case status it said the case in Administrative processing and we need to visit US Moscow embassy for further information. I received e-mail "Welcome letter" only yesterday!!!!! and my fiancé still did not received  "packet 3". So, we did not wait for official packet, he paid his visa on Friday July 7, we fill  out DS-160 on Sunday July 9th, on July 11 the payment finally went through and we try to scheduled interview but system did not allow us to do it. So, I ask another fellow Russian petitioner if they had experience any difficulties to choose a day for interview, and he suggest just wait one more day for system to be upgraded. 

My suggestion, don't wait official packet, it just waste of time, start fill out DS-160, pay visa as soon as possible, because if fiance will use postal service for payment it will take time for embassy to received it, if you will pay by credit card it take a few hours. There is a link for your fiancé with helpful information about how to fill out DS-160 and schedule interview day. http://fiancee-visa-usa.blogspot.ru/2013/04/blog-post.html  Is a Russian fiancé blog, I found out that is helpful, even the info from 2013.
