For the purpose of bringing a non-US citizen to the country, the onus for financial support and strength of assets lies solely with the American citizen.

 

For a K1, assets or indeed income held by the non-US citizen do not count towards the funds required to meet the poverty guidelines. As the US citizen you act as the sponsor, showing you have the income and/or assets required to support both you and your spouse when they enter the United States, as they will not be able to work for around 3 months after entering. The classification of the non-US citizen as a public charge stems from whether or not they would become dependent on the government for income and financial support, as a result of the US citizen not having adequate funds.

 

It's worth noting that you can also list a co-sponsor, who must be a US citizen, to also declare their assets and income as means by which to support you both, for example a family member.

Hi fam!

I felt like sharing my journey with the feb filers :)

Our I-129f has been received feb 1 and we got our NOA1 already and we're now playing the waiting game.

 

Our situation is a little tricky since my fiance and I currently live together (I'm working abroad). Once we get the NOA2, I've got a job waiting for me back in the States (since I must be domiciled to petition her when doing the AOS from what I understand) so hopefully all works out. We'll have our civil ceremony after getting approval (fingers crossed) and we've already booked our wedding venues for a more traditional wedding ceremony next year in June. Hopefully we'll be settled in the United States by then.

so i don't want to excite you guys, but i just wanted to share that i saw one mid-feb filer got an rfe dated march 15. only just that one case though - so maybe an expedited case (or they were just really really lucky to have their case already touched)!

Hmmm maybe they will just jump over everyone right to us?! LOL!!! Must have been an expedited case.  But on the bright side, we are about 33% done in our wait for the NOA2 if the average is around 90 days right now :)

Yesssssss 1/3rd of this part of the wait is complete!! Hoping that VJ's estimated NOA2 date is correct, although mine moved from a May date to June <_<

Mine also moved back about a week and a half.... We can always pray we'll be the first ones sitting on top of the pile, right?!?   I see you are also going through the Montreal consulate.  Hopefully that won't be moving too slowly when we get to that part ?.

Haha, yes fingers are definitely crossed!  Hoping all of us have a smooth process and that it speeds up a little. Seems as though there are many November filers still waiting and they have reached over 90 days waiting.

 

Yup I will be going through Montreal, I haven't seen much posting on here about appointment timing, so just another part of the waiting game to find out. I did notice many people saying that after NOA2, the process seems to go along much quicker, at least.  I am getting prepared in advance, reviewed packet 3 already, and am gathering what I can for now.. keeping myself busy  :)

I wish there was more transparency on the USCIS side.  You would think that processing would speed up now that they have worked through the date of the fee change and the increased number of submissions leading up to that date.  On the flip side, I fear they are working a large number of RFEs from the wave prior to the fee increase which is slowing the approval rate for us February filers.

I saw someone post last week about Montreal, saying there was interview slots available every wednesday from march 22 (today!) Until the end of April.  Another Canadian posted today they have an interview the middle of April and they also just booked recently, so I would be happy with that wait time if it keeps up!!  I have been keeping myself busy too and trying to work a ton.  I keep telling myself that if I can't be with my fiance, at least I can get enough funds saved up in order to keep paying my leftover Canadian bills while im in the US and cannot work.

What kind of things can we start gathering now? I just had a second visit with my fiancé so I am going to print more pics, my visa, and itinerary. Anything else I can do?

Im not sure what is embassy specific (In canada you can download a checklist), but I ordered my long form birth certificate, am making sure my vaccines are up to date, made photocopies of my biographic passport page and birth certificate.  I am going to get my police record done once I get my NOA2 I think since in Canada you get it quite quick. I also went online and practice filled out my DS-160 to make sure I have all the info required.  It saves there for a month but I think I read you could save it to your computer (I didn't try yet).  You can also download the form for support and get an idea of what is needed for that (although wait for NOA2 to start gathering).  I am going to have a small sample of.evodence for my relationship, but apparently it is very rarely asked for in Canada.

I got my fiance's I-134 Form (and co-sponsor's), just told them to skip the Box with the date so I can fill it before the Interview. Also I took fiance's letter of intend also without the date, some pictures, letters of employment from employer, pay stubs from fiance (co-sponsor will send that later), also they are fixing their taxes now and send it soon. I think that is it from them. I myself am thinking about making vaccines earlier, still didnt make my mind yet. I got my birth certificate already and will make my police check later cause it is valid only 6 months I guess and its easy to get, I can get it same day. Im not doing nothing else earlier than I get my noa2, cause it will be still over a month after I get it to fill all the paperwork so it is plenty of time.
