Politics isn't enough for an asylum claim.  Is he going to lose his life over it?  Is there a huge reason why he cannot return home?

When he went to apply for USA papers they've told him that he is legal and he can not get his papers now. This happend in buffalo and many Cubans in Miami got his papers the same way. Looks like New York State is different from Miami. They don't care about Cuban law

Yet again 'politics' is not the reason for an asylum claim. Anybody can claim for asylum, frivolous claims are not looked upon kindly.

What do you mean they don't care about Cuban law? What does the laws of Cuba have to do with New York?

 

I lived in Miami most of my life so I know there is a strong Cuban community there and I know of plenty who fled Cuba and gained status in the US.. But what I honestly think your husband was trying to do was based on the past wet foot/dry foot policy which is now over.

 

Again, I think your husband greatly misunderstood his options and needs to take some time and figure out his next best course of action. Right now it seems he is just going to claim asylum because he doesn't know what else to do. You have to have a valid reason for asylum. For example, people from Syria can claim asylum because there was literally bombs being dropped in there country.

Try to get in contact with an immigration attorney from Miami ( just google it) there's 100's that specialize in the Cuban situation due to the big community here. I'm sure they can help you and give you the right orientation about your bf's situation.

Thank you, I will do that I don't see any other option, he got arrested before law changed,

Well that makes sense they saw through the game

ppl can get asylum if eligible in the first country they

land of course Canada would not give him asylum,

and the Cubans are just like any other country now wet

foot is over  He applied for tourist visa, told CBP he is

a tourist when he arrived, then he headedt o the border

to apply for Canadian asylum? that shows

an elaborate plan to circumvent immigration rules before

arriving, he did that in 5 days

 I am very tired of all situation. My bf come to a friend who invite him to USA, he is Cuban also and the next  day my bf got to USA he took my him to USA border to apply  papers. I come to USA that day and it was already done, they told him that he is legal in USA an de ge can't get papers. That friend was telling my bf what to do and that's why he got in trouble. My bf went to USA border 2 times because of his friend. His friend was fighting with me a lot he just wanted papers for my bf. I was very tired of everything that's why i ask my bf if he wants to go with me to Canada, but because he asked many times before for USA papers they send him back to USA border and they arrested him. It was not his fault, usually people which comes to other country they don't know what to do and they listen to other people. His friend is a gay and I could see how much he was furious that we were together. I told my bf that I don't want to see his friend anymore and we were spending time alone, his friend was texting him and calling him all the time without respect like he is husband girlfriend. That's why he didn'twanted to go back to live with him. Judge told us that after 1 year and one day he could apply for papers but now it's to late. I don't know if we should tell all that story you the judge and if it will help but this is the true. My bf is in the jail over one month and his friend who lives there never went to see him, I am there every week. I want the best for my bf and I hope we can fix everything, because it was not what we expected. I didn't know nothing about my bf for 9 days because his friend told me that I can't call imigration and ask for him because everything is my fault what happend to him. That the only person who he can contact is his family and because I am just a girlfriend from Canada I can't do nothing. That i have to dissapear for his good. He lied to me that my bf can't see me and he can't  call me. He start telling many different stories and then i realized that he lies. I found phone number of the jail in batavia address and I went to sa border ask If i can see my bf, they told me that I can. That day I found him and I stop talking with his friend because everything he said was a lie. The day he go to arrested he put on my bf Facebook that post. People who knows Spanish will understand. All that it is a lie. I would like to help my bf, this is not his fault.

Well he should have researched a major life changing process, that definitely is on him.

Right, because he was apprehended at the border and has no right to remain here.

He obviously sees you as responsible and is angry.  People say things like that when they're angry.
