Bringing In Laws to US

I'm sorry if this has been brought up before but I'm having trouble finding an answer especially with using the site on my phone. This is a future situation but didn't know if there is an answer. My hubby is a LPR and eventually wants to apply for citizenship. His parents are both UK citizens and are retired and would like to know if there is an option for them to travel for 6 months here in the United States then go back to the UK for 6 months and continue to do so. Truth is the want to see their grandchildren as much as they can and spend time with us as well. But we didn't know what options they have.

They can apply for the B2 visa, tourist visa, which allows (usually) to stay 6 months in the US. But it's not for LIVING in the US. So in laws do couple of trips like that, and they might not be allowed in the US anymore.

 

Family sponsorship (green card) is also out of question, since this one is in fact for living in the US permanently for most of the year. Traveling between UK and US would probably result in their green cards being taken away.

 

That's it for options.

 

I guess they can use VWP to enter the US for 90 days and then leave and then repeat. Again, too many trips too often also raises suspicions.

They will be able to do it with a valid visa be there is a couple of things you should know.

 

  • 6 months stay is NOT guaranteed. It is determined by the Point of Entry officer at their entrance in the US. The office could only permit them to stay for 2 weeks.
  • If the in-laws continue to stay in the US for long periods of time they will be at risk of having their visas revoked for abuse. You can search this site and find many cases where it has happened.

As stated already a visitor visa is for visiting and spending that much time in the US is practically living here.
