Online dating sites (IMBRA?)

Hello everyone,

 

I need some help here.

We've recently submitted our petition for the K1 Visa. My question now is, do online dating sites, like in our case International Cupid, fall into the IMBRA?

We assumed IMBRA referred to Mail Bride kind of services but now that I've read more, it seems kind of blurry.

Did you read the TOS on the website you met on? When it's not an IMBRA site it usually says so in the TOS.

 

And it's not blurry, IMBRA is only if you pay the website to find you a person to marry. Regular dating sites don't take your money and pare you with someone, you do it all yourself even if you pay for membership or not.

The (main) purpose of IMBRA is to prevent types of things like mail order brides. I'm not too familiar with International Cupid, but a quick Google search indicates it shouldn't fall under the restrictions. That said, if I had to look it up, then it's fair to assume USCIS may not know what it is either...and don't expect them to Google it. You may get an RFE and need to provide evidence...which is normally just sending them the TOS, a statement from the site, etc.

I checked the TOS and in part 3 it says:

The Service is an internet information service that facilitates contact between members who may or may not be seeking friendship or a relationship. It is not a marriage brokering service, mail order bride service or a matchmaking service. The Company is under no obligation to broker any other member or members for you.

You should print the TOS, highlight the marriage broker part and send it with your i-129f to avoid potential RFEs.

If doubt, you can probably email the support team in the online dating website, I am sure they will clear ur head! I met my fiance through OkCupid, got RFE (which delayed the K1 process). My advice to avoid getting case delayed, do your homework about the website

-Provide proof it is not IMBRA (email from support team, terms and conditions stated it is not IMBRA....)

You got an RFE for this using OKC? Dang...that's what I used. I checked on this prior and it sounded like the "big 3" (eHarmony/Match/OKC) US dating sites were well enough known to avoid this.
