Likelihood of K1 denial being pregnant and previous drug use.

Hey guys.

 

So I'm currently 8 months pregnant with my fiancées baby. I attended the medical in Knightsbridge London and was completely honest about my previous drug use of smoking marijuana. However, I did quit in 2009 and haven't touched the stuff since, partly due to my job in healthcare and the possibility of random drug tests. I was given a urine drug screen, which I know I'll pass 1000%. 

 

However, upon reading testimonials from here, it seams that even my admission to previous drug use will result in a denial. I'm completely devastated to say the least, as my fiancée will miss out on the most important time in his child's life. He will be attending the birth and stay with me for 6 weeks but will have to return due to his job.

 

On top of this I have a criminal record. I have a juvenile criminal conviction for going equipped for theft (not actual theft itself) for which I received an absolute discharge. I also have an arrest for disorderly conduct which I recieved a penalty notice for and also an arrest for Threats to kill, which I know on paper looks alarming, however, I recieved No further action for that. 

 

I feel like I'm going to be punished for my past :(

 

Are there any hardship waivers or anything that I could submit?

 

Whats the likely hood of me being denied?

14-AUG-2017- Received NOA1 by mail

24-AUG-2017- Received letter for Biometrics

05-SEPT-2017- Biometrics done at Milwaukee Field Office 

10-OCT-2017 - RFE for AOS I -485 

17-OCT-2017 - RFE received by USCIS

15-NOV-2017 - EAD Card in production 

24-NOV-2017 - EAD recieved on the mail (Online still says preparing card) 109 days total after receiving application.

11-DEC-2017 - Interview notice Recieved 

15-FEB-2018 - AOS Approved

This is of course all guesswork, but...

Assuming both criminal charges were as a minor/ a long time ago, I think your chances of getting a visa are decent, but there likely will be a delay of a year with random drug testing before they grant it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

If they would ask you about drug use you would say that you did use drugs before? Or just say no? meaning that saying yes could result in one year ban.

I was completely honest with them. I had to be because my previous drug use had also been mentioned to my personal doctor. I was worried in the medical that it may mention it so I was honest. I told the medical doctor I had previously taken weed on numerous occasions but that I had stopped in 2009. So it would have been 7 years since my last drug use. I thought it's best to be honest just incase it was something that had been put in my medical report that they had requested from my doctor.

Always, always, always tell the truth in this process. Whatever the consequences for your past actions, the consequences for lying willl ALWAYS be worse.

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

100% Agree with you. If they find out you lied you can kiss goodbye to any prospect of any visa to the usa
