Hoping for some opinions on this. Hubby and I currently rent an apartment. Lease runs out at the end of August. We just signed a non-renewal letter and have received a letter back from our landlord stating that it's been rented out and we need to vacate by the end of our lease. We are hoping to buy a house but that process won't start until April. We file for ROC in 10 days.

 

Should we include the non-renewal letter and 'vacate' letter (they are addressed to the both of us), even though we don't currently have any documents to show that we will continue to live together after that time? We have included leases and renewal letters covering the time since our marriage. Our cover letter mentions our intent to buy a house later this year, as does one of the affidavits a friend wrote for us.

 

And yes, I probably am overthinking this :) I've been collecting bits and pieces of evidence for 2 years and now that it's almost time to file I'm anxious to get this right the first time around.

I would not send those two items.  You are proving a bonafide marriage up until the time you submit your documents, and your lease goes until August.

 

Have those letters, plus any updated info you collect from your filing date (yes, keep collecting!) up your sleeve in case you get any RFEs, but since August is in the future, and you don't really know what you situation will be then, I would not send them.

I'll not worry about this. You have leases covered the time since you got married till now and just in case they will need anything more you will either have a mortgage on new house together or another lease so don't worry to much :) I'm also February filer. Good luck.
