No you don't, its not asked for. Just because your lawyer advised you to, doesn't mean its required. If you look at the form yourself you well see that it states that the petitioner's is required and the one of any children you have; regardless if they are your children, theirs, or children you've had together.

I am petitioning for my step son , a minor child ( 13 yo ) .

Wondering if this actually is going to be slower than spouse petition ??? due to safety reason .....

anyone has experience with that ?

This is a picture from the official NVC cover letter. It states to have the petitioners civil documents. I discussed in several other threads what that exactly means and I was told it means their birth certificate and any other previous marriage certificates! 

I also submitted my husband's birth certificate (he's petitioner) and I've had no troubles so far. If people are getting a RFE or Check list from NVC stating they need to submit that - that is not the NVC's mistake. That is because it's required!! Simple as :)

We weren't talking about the NVC. This was started about the I-130 petition and if the beneficiary birth certificate was required. Which it's not for that process but yes I know when you get to the next step in the process (NVC) then it's officially required.

Hey! Of course!

 

It's way easier than the I-130 obviously, you go http://www.immd.gov.hk/eng/services/visas/residence_as_dependant.html for instruction and form downloading (form might be different depends on whether petitioner is currently in HK).

Since i'm in HK so all i did was filled in the form, included some civil docs, some photos of ours and mailed it to the Immigration HQ. Few days later i received a case receipt notice saying it will be done in 6 weeks.

 

I did it for husband for his future possible job opportunities in HK (we met here when he was an expat) and more importantly using ID card is way faster to get in from airport.

If you follow the TSC thread, there was a discussion about it. On paper we do not have to include it. So we will not receive "Request for Initial Evidence" if we have included everything on the form instructions.

 

But some of us from TSC received "Request for Additional Evidence", which is whatever USCIS wants to see even tho it was not required, and some of them were asking for a beneficiary's birth cert.

 

I would say we do not have to but i wish i had included it (which i have not and now getting nervous about getting a RFE and hoping for approval) and i would recommend people to include it.

Oh I know it's required BUT for NVC filing. Not for USCIS. The conversion orginated from an RFE for an I-130.. which doesn't ask for the beneficiary's birth certificate only petitioner and kids. :):)

There is the checklist.. it only requires petitioner's not beneficiary's.

me too I send mine my spouse and kids I did it my self but looking on the internet I saw a page were it said tos send all the birth certificates

I learnt today that I did get approved, followed the advice on here, and called, the No on page thirty something of this Forum. Actually my PD date was March 3rd but surprisingly got approved. Got the info from Tier one officer who answered the call. I have to wait to get the mail as it was just approved Monday. So excited. Texas Service center finally woke up.

Advice to rest of you, Prayers, Patience and make calls you may just have an approval already.
