Failed to register with Selective Service - N400 denial?

Hi guys,

 

Can someone help me figure out if my husband should apply for naturalization?

 

He came to the US when he was 25, he is now 28. We've started filling out the N400 application (under the 3 year rule). We thought he was automatically registered for the selective service as part of the CR1 visa process, but apparently that's not how it works. We called the SS office and they said his name is not in their system. We've requested a Status Information Letter from them and we'll include our own separate letter in our N400 packet explaining the misunderstanding -- is this enough? How common is it for men to have their N400 applications denied due to failure to register with the Selective Service?

 

Should we just wait until 2019 when he is 31 years old?

 You can try using an explanation but usually they want 5 years of good moral character to overcome this oversight.

Thanks. That's what I'm realizing as I read through similar threads. I guess we'll play it safe and just wait until he's 31.

Best to wait. The N400 application fee is steep and non refundable.
