I-134 Affidavit of Support (Tax Documents)

Quick Question.

For the I-134 Affidavit of Support, K1 Visa, Consulate/Embassy Interview. (Frankfurt Embassy)

The instructions on the form say (Section II Supporting Evidence):

"Evidence should consist of copies of any or all of the following documentation listed below that are applicable to your situation."

I could almost swear I read somewhere on VJ that I should send original supporting evidence for my previous tax return(s). Of course I can't find that now :blink: No mention in the guides either (except about original I-134 and signature). IRS Transcripts not an option due to time constraints.

So the question is:

I'm submitting my previous tax return as part of the Affidavit of Support (I-134) - do I need to attach original supporting evidence for the return (i.e., W-2, 1099, etc)? or copies (as the instructions say).

Follow Up:

On the I-864 Affidavit of Support Instructions - it clarifies further that copies of tax returns are acceptable as long as you have copies of the W-2s/1099's etc.. so perhaps I'm just over thinking or imagining I've read that originals were/are required..

When you think this through a little... Your originals are on file with the IRS, so what you actually have in your possession is already a copy...

Copies are fine, also they will accept tax-transcripts in place of the (1040,W2,1099)

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (2005,04,03)
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating anual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

Virtually all consulates treat K-1, and K-3 visas like any other immigrant visa and use the same evidence standards used by the I-864 with the I-134, I-864 indicates Employer letter, and pay stubs are optional. Letter from bank is only needed in cases where income is less than 125% of the poverty line and assets like bank balance is needed to make up the difference.

According to the instructions that come with the I-134, tax returns are not required unless you are self employed. If you are self-employed then the instructions state: "Copy of the last income tax return filed."

I've seen on here that people have written that the last three years are required but the I-134 doesn't say that. Where is it written that the sponsor has to provide three years of tax returns/IRS statements? Thanks.

In our case I felt don't give them something to use to deny and request more, remember the I-134 is used for all types of non-immigrant visas, but the K-1,K-3 visas are not your average non-immigrant visas, and are processed like immigrant visas, the consular officer applies the standards required by other immigrant visas to the K-Visas so they used the financial evidence requirements that are expected of immigrant visas, those requirements are spelled out in the I-864 instructions.

Here is another question... When my employer writes the letter, should the consulate's address be included like in any other business type letter or just not worry about it?

03/16/03: Met the love of my life

01/24/06: Officially began our relationship

11/01/06: He proposed marriage :)

02/17/07: I-129F Sent to NSC

02/23/07: I-129F NOA1

02/28/07: I-129F NOA2 (found out while checking on-line)

03/02/07: Received hard copy NOA1

03/08/07: Received hard copy NOA2

03/13/07: NVC sent packet to La Habana

03/27/07: Telegram "sent" to fiance to pick up packet 3... never received

04/02/07: I contacted the "embassy" to find out status of case and set up pick up date

04/04/07: Fiance picked up packet 3

04/05/07: I called toll-free # here to set up appointment for my fiancé

05/10/07: Interview scheduled for 7:30AM... Visa Approved!!!!!!!!

05/14/07: Picks up passport/visa and brown sealed envelope

05/15/07: Paperwork for the carta blanca turned in

05/24/07: Carta Blanca received and bought plane ticket

06/04/07: Entry into the US... together again!!!!!!!

08/07/07: MARRIED!!!!!!!!!!!!!!

Can be addressed to To Whom It May Concern.
Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company letterhead.

The instructions for I-134 are not the instructions meeting the public charge provisions of the law for non-immigrant visa applicants. For that, see DS-2000, formerly designate OF-167, which will tell you what types of documentation can be submitted.

As a practical matter one submits what the consulate and consular officer wants them to submit, if what they want exists, and tax returns are often requested whether or not the sponsor is self-employed.

The way I read the instructions is, you'll need the last 3 years of tax returns if you work for someone or a company, and only last years tax return if you're self-employed. I haven't found any instructions for other required evidence for self-employed, they may request. The I-134 form says see additional instructions for self-employed, but there are none, not that I've seen.

Just make it easier on yourself and give them more than enough information. I'm turning the following info:

-Past 3 Years IRS Tax Transcrips

-Past 7 Years W2

-Past 7 Years Tax Returns Form 1040

-Paystub from 08/18/2005 To Present

-Almost letter from employer (check out worknumber.com)

-Bank Statement including deposit and withdrawal from January 2006 to present.

They can check my kitchen sink including the dish washer if they want. :thumbs:

N-400 for Citizenship.

09/15/2010 Application Sent.

09/22/2010 Check Cashed.

09/23/2010 NOA Sent.

09/27/2010 NOA Received.

10/15/2010 Biometric Appointment.

01/26/2011 Interview Letter.

02/24/2011 Interview Date. PASSED!!!!!!!!

03/25/2011 Received oath ceremony letter

04/21/2011 Oath Ceremony @ 12:30PM

Oath Ceremony Completed. Now A US Citizenship.

I-130 Petition for Mother

09/29/2011 Received Email With NVC Number, Fee, And Choice Of Agent Form.

You can e-mail the consulate and ask them directly.

I told them my salary and what I had prepared and did I need the bank letter.

As far as copies...I brought everything with me to Brazil to attend the interview with my fiance. The woman at the consulate sent me out to make copies of my tax return (they told me to only present last year's at the interview) and of my letter of employment, etc.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

me and my fiance are preparing documents for her k-1 visa interview..

i-134 said if self employed then send copy of tax returns.. i did not send any of that.

i just send all the requirements that was ask

" did anyone went for an interview and did not have the tax returns and got denied

or got approved?
