Hello, after my husband's file went back to USCIS (after being denied), I did not receive an NOIR / NOID or any request for any further information.  HOwever, I have to say that at the very beginning, we submitted a lot of evidence ....of our time living together in Ghana, joint finances, etc.  So after 13 months of waiting from the time he was denied, the case was reaffirmed without need for additional evidence.  It went back to the NVC at the end of December of 2016 and now I'm contacting the embassy to see where it is..  They are saying they don't have it yet.  I've gotten my lawyer and congressperson involved.  I hope this helps.

Okay thanks so much,  we're hoping the same, because we provided a lot of evidence when I applied for my husband, and we took a lot too to the interview, but co didn't look into our document. So I'm praying we won't get any noir, but all the same we are gathering more evidence, because I go home every year to visit him, just came back two weeks ago.  I hope they received ur documents soon,  it's frustrating, but let's continue to pray and have faith,  our God is able, it has not been easy, but we're keeping our faith.

Hello trustG, thank you for the encouraging words, and I wish all the same to you and your husband.  It definitely is not an easy road, but we have to trust and have faith, that is for sure.  It's a good idea to gather evidence on what you believe the problem was, why a 221g was issued.  IN our case, the CO would not tell my husband what the problem was.  She did not check anything on the checklist, so we just had to go over what she was sticking on in the interview and get something together to counter that.  But in our case, as I typed before, it was reaffirmed without need for the additional info. But he will take it just in case for the 2nd interview.

Same apply to us,  I was there at the interview with my husband Sept 2015, but the time we present our documents and the time she called my husband for the interview, I told my husband I don't think the lady has gone through our evidence, because there's no way she could read them that fast, even our phone records alone from 2013 to 2015 would take her almost 30 to 45 minutes,  plus our our charts records and letters from our families,  so my husband took the oath and she started the interview, I was sitting right behind him, so I heard all the questions and his answers to her. And she asked my husband when am I returning to US,  my husband told her and she gave him another date to come, because we have to correct something on his DS 260, and also we need our original marriage certificate and co sponsor,  and I jump in and told her no we don't need to sponsor, because I make more money than the required income, she should take a look and also with our marriage certificate she's holding it in her hand,  hmmmm that lady turn off the light and walk away. I was so upset,  so my husband went back and she gave him another interview in November 2015 , that's when she told him, she doesn't think we have a strong relationship,  my senator office enquired about the case, and she told him our marriage is fraud,  I cried on the phone that, like this world has come to an end.  But my husband keep encouraging to let's on God's time, because God's time is the best he said.  For two weeks now since I came back from Ghana I cry everyday. It's not easy

Believe me when we were denied two years ago for fiancé, my days are still filled with tears. Even later when I applying for a spouse visa I would have mini breakdown in front of the computer. All I can say is be encouraged. Some might say you didn't have enough evidence...I frontloaded....some might say you weren't organized....Everything was well organized and labeled. And no they don't look through all the evidence. One thing they should know is that the culture is different in Ghana from America. I was there, the way the woman spoke to us and addressed us was all rude. Some people make it through while others pray, fast, prepare, and still get denied. I married my husband because I love him not for him to receive a green card. How do you explain this to someone who already has their mind set that it's fraud?

Yes  OhBoye,  that lady caused a lot of harm in 2015 to many people. But like u said, she has made up her mind those she will grant and those she will not,. God will see us through.

Insha Allah, I'm one of that lady's victims in November 2015. But we have responded strongly, and by the Grace of Allah the case was reaffirmed in December 2016, waiting for another interview... Hope this time around we will be fine. Let us all pray.

Hi nyala62, how are u,  it's been a long time. Glad to hear from u my brother.  I'm glad urs have move forward.  Did u get a lawyer or u respond to them urself?  Also ours was sent back in March and uscis received it in April,  and I know we went to the interview before u guy's,  so just curious about how urs has been responded faster. Once again I'm happy to hear from u my brother.

trustG Yes it has been a long time, No I did not hire an attorney, I did everything my self by filing an appeal/motion to reopen or reconsider and I won. my wife's case was reaffirmed. But I sought the help of my Senator to have the case sent back in time for rebuttal. So I contacted the senator once again to help me find out the interview status for the case,

So what is the current status of your case? May God Almighty help us all , Amen

@nyala62. Thanks for your response.  Right now we're waiting for the noir,  I have not received it yet, which I'm praying that they will just reaffirm the case,  I went to infopass before I left for Ghana last year, they said they don't have any timeframe for return petitions,  so I came back and contact ombudsman, they said I should hear from them within 45 days, so I'm waiting. How did u get them to speed up the return petition,  because we went our interview in September,  but it was November that she refuse to issue the visa and case sent back to nvc in March and uscis received it in April of last year. So can u pls inbox pm for any kind of information that will help.  Thanks a lot,  this process is giving me a sleepless nights.

Have been denied for Fiancé and Spouse that shows how wicked Ghana embassy is. They just destroy relationships and marriages.  Any consular that made bad decisions with my petition will not go free .. Because they just waste time and frustrate people for no reason.  

 

How long does does it take to get the NOIR because I was denied last year October and still no update. Don't know if I should refile a new petition

We've been refuse visa since November 2015, up till now, we have not heard anything. I contact my congressman this morning and sent an attachment of my recent trip to Ghana to visit my husband and our second year anniversary celebration and our second trip to Dubai pictures.  So his office said they will contact uscis with my email and the attachments and get back to me, hopefully tomorrow God willing. I understand your frustration, I have been crying since I came back, it has not been easy. 

I don't think u should file another petition, just wait for the noir,

Ebunoluwa and all experienced VJ members. I'm very confused about this new update (Expiring Soon) while waiting for my reaffirmed CR1 interview, Is that normal or possible? Do I need to contact NVC or the Consular about this? O is this an error message? I really an explation

After waiting for 12 months since our case was sent back finally got the noir with attachments from the co with a bunch of lies in her findings for refusing the visa, thank God I was sitting right behind my husband when the interview was going on.  I never knew those co can lied like this.
