My wife came to the USA on a K1 Visa, in 2015 she left 3 small children in Philippines to bring to USA later. We had a car accident with injuries and it delayed our AOS process, and getting her kids here to the USA. Can i claim my wife, and her 3 kids as i have been supporting them with all their needs while still in the philippines for over 2 years? Not complaining just need to know. i love her kids the same as i love my own

Unfortunately, you can't, not yet anyways. One of the definite rules I believe is that the dependent must be a US citizen or LPR with a social security number.

I'm pretty sure you can not claim the children as they are not technically in your household and are not residents of the US yet.

As I read the article, I saw these two conditions that you must comply to:

- The child lived with you for more than half the year

The child must be a U.S. resident alien, U.S. national, or a resident of Canada or Mexico

I ran into a similar issue last year. I wanted to claim my spouses children that had been residing with me for 9 months of the year. We were stationed at a military base overseas and I could not claim them because they were not LPR of the US yet and they did not live in the US for over half the year. No exceptions. They must be living with you in the US or be LPR.
